A privateer is a private person or vessel which engages in commerce raiding under a commission of war. Since robbery under arms was a common aspect of seaborne trade, until the early 19th century all merchant ships carried arms. A sovereign or delegated authority issued commissions, also referred to as letters of marque, during wartime. The commission empowered the holder to carry on all forms of hostility permissible at sea by the usages of war. This included attacking foreign vessels and taking them as prizes and taking crews prisoner for exchange. Captured ships were subject to condemnation and sale under prize law, with the proceeds divided by percentage between the privateer's sponsors, shipowners, captains and crew. A percentage share usually went to the issuer of the commission (i.e. the sovereign). Most colonial powers, as well as other countries, engaged in privateering.

Privateering allowed sovereigns to augment their naval forces at relatively low cost by mobilizing privately owned armed ships and sailors to supplement state power. For participants, privateering provided the potential for a greater income and profit than obtainable as a merchant seafarer or fisher while avoiding the dangers associated with outright piracy. However, the line between privateers and pirates was not always clear.

A declaration of war is a formal act by which one state announces existing or impending war activity against another. The declaration is a performative speech act (or the public signing of a document) by an authorized party of a national government, in order to create a state of war between two or more states.

The legality of who is competent to declare war varies between nations and forms of government. In many nations, that power is given to the head of state or sovereign. In other cases, something short of a full declaration of war, such as a letter of marque or a covert operation, may authorise war-like acts by privateers or mercenaries. The official international protocol for declaring war was defined in the Hague Convention (III) of 1907 on the Opening of Hostilities.

A letter of marque and reprisal was a government license in the Age of Sail that authorized a private person, known as a privateer or corsair, to attack and capture vessels of a foreign state at war with the issuer, licensing international military operations against a specified enemy as reprisal for a previous attack or injury. Captured naval prizes were judged before the government's admiralty court for condemnation and transfer of ownership to the privateer.

A common practice among Europeans from the late Middle Ages to the 19th century, cruising for enemy prizes with a letter of marque was considered an honorable calling that combined patriotism and profit. The Drake Passage is the body of water between Cape Horn in Chile at the southern extreme of the South American mainland and the South Shetland Islands of Antarctica. It connects the southwestern part of the Atlantic Ocean (Scotia Sea) with the southeastern part of the Pacific Ocean and extends into the Southern Ocean. The passage is named after the 16th-century English explorer and privateer Sir Francis Drake.

The Drake Passage is considered one of the most treacherous voyages for ships to make. The Antarctic Circumpolar Current, which runs through it, meets no resistance from any landmass, and waves top 40 feet (12 m), giving it a reputation for being "the most powerful convergence of seas".

The Spanish Armada (often known as Invincible Armada, or the Enterprise of England, Spanish: Grande y Felicísima Armada, lit.'Great and Most Fortunate Navy') was a Spanish fleet that sailed from Lisbon in late May 1588, commanded by Alonso de Guzmán, Duke of Medina Sidonia, an aristocrat without previous naval experience appointed by Philip II of Spain. His orders were to sail up the English Channel, join with the army of Alexander Farnese, Duke of Parma in Flanders, and escort an invasion force that would land in England and overthrow Elizabeth I. Its purpose was to reinstate Catholicism in England, end English support for the Dutch Republic in the north and prevent attacks by English and Dutch privateers against Spanish interests in the Americas.

The Spanish were opposed by an English fleet based in Plymouth. Faster and more manoeuvrable than the larger Spanish galleons, its ships were able to attack the armada as it sailed up the Channel. Several subordinates advised Medina Sidonia first to enter Plymouth Sound and attack the English fleet before it could leave harbour and then to anchor in the Solent and occupy the Isle of Wight, but he refused to deviate from his instructions to join with Parma. Although the armada reached Calais largely intact, while awaiting communication from Parma, it was attacked at night by English fire ships and forced to scatter. The armada suffered further losses in the ensuing Battle of Gravelines and was in danger of running aground on the Dutch coast when the wind changed, allowing it to escape into the North Sea. Pursued by the English, the Spanish ships returned home via Scotland and Ireland. Up to 24 ships were wrecked along the way before the rest managed to get home. Among the factors contributing to the defeat and withdrawal of the armada were bad weather conditions and the better employment of naval guns and battle tactics by the English.

Privateer in the context of Piracy

Piracy is an act of robbery or criminal violence by ship or boat-borne attackers upon another ship or a coastal area, typically with the goal of stealing cargo and valuable goods, or taking hostages. Those who conduct acts of piracy are called pirates, and vessels used for piracy are called pirate ships. The earliest documented instances of piracy were in the 14th century BC, when the Sea Peoples, a group of ocean raiders, attacked the ships of the Aegean and Mediterranean civilisations. Narrow channels which funnel shipping into predictable routes have long created opportunities for piracy, as well as for privateering and commerce raiding.

Historic examples of such areas include the waters of Gibraltar, the Strait of Malacca, Madagascar, the Gulf of Aden, and the English Channel, whose geographic structures facilitated pirate attacks. The term piracy generally refers to maritime piracy, although the term has been generalized to refer to acts committed on land, in the air, on computer networks, and (in science fiction) outer space. Piracy usually excludes crimes committed by the perpetrator on their own vessel (e.g. theft), as well as privateering, which implies authorization by a state government.

Privateer in the context of French corsairs

Corsairs (French: corsaire) were privateers, authorised to conduct raids on shipping of a foreign state at war with the Kingdom of France, on behalf of the French crown. Seized vessels and cargo were sold at auction, with the corsair captain entitled to a portion of the proceeds. Although not French Navy personnel, corsairs were considered legitimate combatants in France (and allied nations), provided the commanding officer of the vessel was in possession of a valid letter of marque (lettre de marque or lettre de course, the latter giving corsairs their name), and the officers and crew conducted themselves according to contemporary admiralty law. By acting on behalf of the French Crown, if captured by the enemy, they could in principle claim treatment as prisoners of war, instead of being considered pirates.

Because corsairs gained a swashbuckling reputation, the word "corsair" is also used generically as a more romantic or flamboyant way of referring to privateers, or even to pirates. The Barbary pirates of North Africa as well as the Ottoman Empire were sometimes called "Turkish corsairs".

Privateer in the context of Prize money

Prize money refers in particular to naval prize money, usually arising in naval warfare, but also in other circumstances. It was a monetary reward paid in accordance with the prize law of a belligerent state to the crew of a ship belonging to the state, either a warship of its navy or a privateer vessel commissioned by the state. Prize money was most frequently awarded for the capture of enemy ships or of cargoes belonging to an enemy in time of war, either arrested in port at the outbreak of war or captured during the war in international waters or other waters not the territorial waters of a neutral state. Goods carried in neutral ships that are classed as contraband, being shipped to enemy-controlled territory and liable to be useful to it for making war, were also liable to be taken as prizes, but non-contraband goods belonging to neutrals were not. Claims for the award of prize money were usually heard in a prize court, which had to adjudicate the claim and condemn the prize before any distribution of cash or goods could be made to the captors.

Other cases in which prize money has been awarded include prize money for the capture of pirate ships, slave ships after the abolition of the slave trade and ships trading in breach of the Navigation Acts, none of which required a state of war to exist. Similar monetary awards include military salvage, the recapture of ships captured by an enemy before an enemy prize court has declared them to be valid prizes (after such ships have been condemned, they are treated as enemy ships), and payments termed gun money, head money or bounty, distributed to men serving in a state warship that captured or destroyed an armed enemy ship. The amount payable depended at first on the number of guns the enemy carried, but later on the complement of the defeated ship.

Confiance, launched in 1797, was a privateer corvette from Bordeaux, famous for being Robert Surcouf's ship during the capture of the British East India Company's East Indiaman Kent. Confiance had captured a number of ships through the years before the British Royal Navy captured her in 1805, taking her into service under her existing name. The Royal Navy sold her in 1810, by which time she had taken part in two notable actions in British service. Confiance then sailed as a merchantman, until 1816.

Robert Surcouf (French pronunciation: [ʁɔbɛʁ syʁkuf]; 12 December 1773 – 8 July 1827) was a French privateer, businessman and slave trader who operated in the Indian Ocean from 1789 to 1808 during the French Revolutionary and Napoleonic Wars. Capturing over 40 prizes, he later amassed a large fortune from a variety of commercial activities, such as ship-owning, privateering, slave trading and owning land.

Surcouf started his maritime career as an officer on the ships Aurore, Courrier d'Afrique and Navigateur. Having risen to the rank of captain, he illegally engaged in slave trading onboard the slave ship Créole. Surcouf then captained the merchantman Émilie, on which he engaged in commerce raiding despite lacking a letter of marque. He preyed on British shipping, capturing several merchantmen including the East Indiaman Triton, before returning to the Isle de France where his prizes were confiscated. Surcouf then returned to France, where he obtained prize money from the government. Returning to the Indian Ocean, Surcouf captained the privateers Clarisse and Confiance, raiding British, American, and Portuguese shipping. He captured the East Indiaman Kent on 7 October 1800. Returning to France, Surcouf was awarded the Legion of Honour and settled down as a businessman.

The Barbary corsairs, Barbary pirates, Ottoman corsairs, or naval mujahideen (in Muslim sources) were mainly Muslim corsairs and privateers who operated from the North African coast, known in Europe as the Barbary Coast, in reference to the Berbers. Slaves in Barbary could be of many ethnicities, and of many different religions, such as Christian, Jewish, or Muslim. Their predation extended throughout the Mediterranean, south along West Africa's Atlantic seaboard and into the North Atlantic as far north as Iceland, but they primarily operated in the western Mediterranean. In addition to seizing merchant ships, they engaged in razzias, raids on European coastal towns and villages, mainly in Italy, France, Spain, and Portugal, but also in Britain and Ireland, and Iceland (commemorated as the Turkish Abductions).

While such raids began after the Muslim conquest of the Iberian Peninsula in the 710s, the terms "Barbary pirates" and "Barbary corsairs" are normally applied to the raiders active from the 16th century onwards, when the frequency and range of the slavers' attacks increased. In that period, Algiers, Tunis and Tripoli came under the sovereignty of the Ottoman Empire, either as directly administered provinces or as autonomous dependencies known as the Barbary states. Similar raids were undertaken from Salé (see Salé Rovers) and other ports in Morocco.

The Jamestown settlement in the Colony of Virginia was the first permanent English settlement in the Americas. It was located on the northeast bank of the James River, about 2.5 mi (4 km) southwest of present-day Williamsburg. It was established by the London Company as "James Fort" on May 4, 1607 O.S. (May 14, 1607 N.S.), and considered permanent, after a brief abandonment in 1610. It followed failed attempts, including the Roanoke Colony, established in 1585. Despite the dispatch of more supplies, only 60 of the original 214 settlers survived the 1609–1610 Starving Time. In mid-1610, the survivors abandoned Jamestown, though they returned after meeting a resupply convoy in the James River.

Jamestown served as the colonial capital from 1616 until 1699. In August 1619, the first recorded slaves from Africa to British North America arrived at present-day Old Point Comfort, near the Jamestown colony, on a British privateer ship flying a Dutch flag. The approximately 20 Africans from present-day Angola had been removed by the British crew from a Portuguese slave ship. They most likely worked in the tobacco fields, under a system of race-based indentured servitude. The modern conception of slavery in the British colonies was formalized in 1640, and fully entrenched in Virginia by 1660.

The Regency of Algiers was an early modern semi-independent Ottoman province and nominal vassal state on the Barbary Coast of North Africa from 1516 to 1830. Founded by the privateer brothers Aruj and Hayreddin Reis (also known as the Barbarossa brothers), the Regency succeeded the Kingdom of Tlemcen as a formidable base that waged maritime holy war (Jihad) on European Christian powers. It was ruled by elected regents under a stratocracy led by Janissaries and corsairs. Despite its pirate reputation in Europe, Algiers maintained long-standing diplomatic ties with European states and was a recognized Mediterranean power.

The Regency emerged in the 16th-century Ottoman–Habsburg wars. As self-proclaimed ghazis gaining popular support and legitimacy from the religious leaders at the expense of hostile local emirs, the Barbarossa brothers and their successors carved a unique corsair state that drew revenue and political power from its naval warfare against Habsburg Spain. In the 17th century, when the wars between Spain and the Ottoman Empire, Kingdom of France, Kingdom of England and Dutch Republic ended, Barbary corsairs started capturing merchant ships and their crews and goods from these states. When the Ottomans could not prevent these attacks, European powers negotiated directly with Algiers and also took military action against it. This policy would emancipate Algiers from the Ottomans.

Piracy had been rampant along the North African "Barbary" coast of the Mediterranean Sea since the 16th century. Algerian pirates and privateers intermittently preyed on American ships, with Algiers extracting annual tribute from the U.S. since 1795; the First Barbary War in the early 19th century, fought primarily against Algiers' neighbors, failed to fully stem the problem.

Privateer in the context of Arnaut Mami

Arnaut Mami or Mahomed the Albanian (fl. 1572–76) was an Ottoman Albanian commander and admiral of the Ottoman fleet and the squadron admiral and the supreme commander of all Islamic vessels in North Africa and Pasha Algiers, known as the most formidable corsair of that period for his terrorizing of the narrow seas. He was also captain general of Ottoman galleys in Algiers. He was called Arnaut after his Albanian origin.

On the morning of 26 September 1575, Arnaut's ship attacked the galley Sol on the Catalan coast, with Miguel de Cervantes aboard. After significant resistance, in which the captain and many crew members were killed, the surviving passengers were taken to Algiers as captives. After five years as a slave, Cervantes was released when his family paid the ransom.
