U.S. Supreme Court in the context of School segregation in the United States

School segregation in the United States was the segregation of students in educational facilities based on their race and ethnicity. While not prohibited from having or attending schools, various minorities were barred from most schools that admitted white students. Segregation was enforced by laws inU.S. states, primarily in the Southern United States, although segregation could also occur in informal systems or through social expectations and norms in other areas of the country. Segregation laws were met with resistance by Civil Rights activists and began to be challenged in the 1930s in cases that eventually reached the U.S. Supreme Court.

Segregation continued longstanding exclusionary policies in much of the Southern United States (where most African Americans lived) after the Civil War. Jim Crow laws codified segregation. These laws were influenced by the history of slavery and discrimination in the US. Secondary schools for African Americans in the South were called training schools instead of high schools in order to appease racist whites and focused on vocational education. School integration in the United States took place at different times in different areas and often met resistance. After the ruling of Brown v. Board of Education in 1954, which invalidated segregated-schooling laws, school segregation took de facto form. School segregation declined rapidly during the late 1960s and early 1970s as the government became strict on schools' plans to combat segregation more effectively as a result of Green v. County School Board of New Kent County. Voluntary segregation by income appears to have increased since 1990.

U.S. Supreme Court in the context of Desegregation busing in the United States

Desegregation busing (also known as integrated busing, forced busing, or simply busing) was a civil rights measure in the United States that came to national prominence in the 1970s. The goal of desegregation busing was to diversify the racial make-up of public schools by transporting students to more distant areas with less diverse student populations. Typically, this involved the busing of black students to schools out of district that were majority white. However, busing also occurred vice versa with the busing of white students to majority black schools.

While the 1954 U.S. Supreme Court landmark decision in Brown v. Board of Education declared racial segregation in public schools unconstitutional, many American schools continued to remain racially homogeneous. In an effort to address the ongoing de facto segregation in schools, the 1971 Supreme Court decision, Swann v. Charlotte-Mecklenburg Board of Education, ruled that the federal courts could use busing as a further integration tool to achieve racial balance.

U.S. Supreme Court in the context of Roe v. Wade

Roe v. Wade, 410 U.S. 113 (1973), was a landmark decision of the U.S. Supreme Court in which the Court ruled that the Constitution of the United States protected the right to have an abortion prior to the point of fetal viability. The decision struck down many State abortion laws, and it sparked an ongoing abortion debate in the United States about whether, or to what extent, abortion should be legal, who should decide the legality of abortion, and what the role of moral and religious views in the political sphere should be. The decision also shaped debate concerning which methods the Supreme Court should use in constitutional adjudication.

The case was brought by Norma McCorvey—under the legal pseudonym "Jane Roe"—who, in 1969, became pregnant with her third child. McCorvey wanted an abortion but lived in Texas where abortion was only legal when necessary to save the mother's life. Her lawyers, Sarah Weddington and Linda Coffee, filed a lawsuit on her behalf in U.S. federal court against her local district attorney, Henry Wade, alleging that Texas's abortion laws were unconstitutional. A special three-judge court of the U.S. District Court for the Northern District of Texas heard the case and ruled in her favor. The parties appealed this ruling to the Supreme Court. In January 1973, the Supreme Court issued a 7–2 decision in McCorvey's favor holding that the Due Process Clause of the Fourteenth Amendment to the United States Constitution provides a fundamental "right to privacy", which protects a pregnant woman's right to an abortion. However, it also held that the right to abortion is not absolute and must be balanced against the government's interest in protecting both women's health and prenatal life. It resolved these competing interests by announcing a pregnancy trimester timetable to govern all abortion regulations in the United States. The Court also classified the right to abortion as "fundamental", which required courts to evaluate challenged abortion laws under the "strict scrutiny" standard, the most stringent level of judicial review in the United States.

U.S. Supreme Court in the context of Joe Biden

Joseph Robinette Biden Jr. (born November 20, 1942) is an American politician who was the 46th president of the United States from 2021 to 2025. A Democratic party member, he represented Delaware in the United States Senate from 1973 to 2009 and was the 47th vice president under President Barack Obama from 2009 to 2017.

Born in Scranton, Pennsylvania, Biden graduated from the University of Delaware in 1965 and the Syracuse University College of Law in 1968. He was elected to the New Castle County Council in 1970 and the U.S. Senate in 1972. As a senator, Biden chaired the Senate Judiciary Committee and Foreign Relations Committee. He drafted and led passage of the Violent Crime Control and Law Enforcement Act and the Violence Against Women Act. Biden also oversaw six U.S. Supreme Court confirmation hearings, including contentious hearings for Robert Bork and Clarence Thomas. He opposed the Gulf War in 1991 but voted in favor of the Iraq War Resolution in 2002. Biden ran unsuccessfully for the 1988 and 2008 Democratic presidential nominations. In 2008, Obama chose him as his running mate, and Biden was a close counselor to Obama as vice president. In the 2020 presidential election, Biden chose Kamala Harris as his running mate, and they defeated Republican incumbents Donald Trump and Mike Pence.

U.S. Supreme Court in the context of Guantanamo Bay detention camp

The Guantanamo Bay detention camp, also known as GTMO (/ˈɡɪtm/ GIT-moh), GITMO (/ˈɡɪtm/ GIT-moh), or simply Guantanamo Bay, is a United States military prison within Naval Station Guantanamo Bay (NSGB), on the coast of Guantánamo Bay, Cuba. It was established in 2002 by President George W. Bush to hold terrorism suspects and "illegal enemy combatants" during the "war on terror" following the September 11 attacks. As of January 2025, at least 780 people from 48 countries have been detained at the camp since its creation, of whom 756 had been released or transferred to other detention facilities, 9 died in custody, and 15 remain.

Following the September 11 attacks, the U.S. led a multinational military operation against Taliban-ruled Afghanistan to dismantle al-Qaeda and capture its leader, Osama bin Laden. During the invasion, in November 2001, Bush issued a military order allowing the indefinite detention of foreign nationals without charge and preventing them from legally challenging their detention. The U.S. Department of Justice claimed that habeas corpus—a legal recourse against unlawful detention—did not apply to Guantanamo because it was outside U.S. territory. In January 2002, a temporary detention facility dubbed "Camp X-Ray" was created to house suspected Al-Qaeda members and Taliban fighters. By May 2003, the Guantanamo Bay detention camp had grown into a larger and permanent facility that housed over 680 prisoners, most without formal charges. The Bush administration maintained it was not obliged to grant prisoners protections under the U.S. Constitution or the Geneva Conventions, since the former did not extend to foreign soil and the latter did not apply to "unlawful enemy combatants". Humanitarian and legal advocacy groups claimed these policies were unconstitutional and violated international human rights law; several landmark U.S. Supreme Court decisions found that detainees had rights to due process and habeas corpus but were still subject to military tribunals.

U.S. Supreme Court in the context of Fair use

Fair use is a doctrine in United States law that permits limited use of copyrighted material without having to first acquire permission from the copyright holder. Fair use is one of the limitations to copyright intended to balance the interests of copyright holders with the public interest in the wider distribution and use of creative works by allowing as a defense to copyright infringement claims certain limited uses that might otherwise be considered infringement. The U.S. "fair use doctrine" is generally broader than the "fair dealing" rights known in most countries that inherited English Common Law. The fair use right is a general exception that applies to all different kinds of uses with all types of works. In the U.S., fair use right/exception is based on a flexible proportionality test that examines the purpose of the use, the nature of the copyrighted work, the amount used, and the impact on the market of the original work.

The doctrine of "fair use" originated as a judicially created common law during the 18th and 19th centuries as a way of preventing copyright law from being too rigidly applied and "stifling the very creativity which [copyright] law is designed to foster." Though originally a common law doctrine, it was enshrined in statutory law when the U.S. Congress passed the Copyright Act of 1976. The U.S. Supreme Court has issued several major decisions clarifying and reaffirming the fair use doctrine since the 1980s, the most recent being in the 2023 decision Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith.

U.S. Supreme Court in the context of Judicial review in the United States

In the United States, judicial review is the legal power of a court to determine if a statute, treaty, or administrative regulation contradicts or violates the provisions of existing law, a state constitution, or ultimately the United States Constitution. While the U.S. Constitution does not explicitly define the power of judicial review, the authority for judicial review in the United States has been inferred from the structure, provisions, and history of the Constitution.

Two landmark decisions by the U.S. Supreme Court served to confirm the inferred constitutional authority for judicial review in the United States. In 1796, Hylton v. United States was the first case decided by the Supreme Court involving a direct challenge to the constitutionality of an act of Congress, the Carriage Act of 1794 which imposed a "carriage tax". The Court performed judicial review of the plaintiff's claim that the carriage tax was unconstitutional. After review, the Supreme Court decided the Carriage Act was constitutional. In 1803, Marbury v. Madison was the first Supreme Court case where the Court asserted its authority to strike down a law as unconstitutional. At the end of his opinion in this decision, Chief Justice John Marshall maintained that the Supreme Court's responsibility to overturn unconstitutional legislation was a necessary consequence of their sworn oath of office to uphold the Constitution as instructed in Article Six of the Constitution.

U.S. Supreme Court in the context of Due Process Clause

A Due Process Clause is found in both the Fifth and Fourteenth Amendments to the United States Constitution, which prohibit the deprivation of "life, liberty, or property" by the federal and state governments, respectively, without due process of law.

The U.S. Supreme Court interprets these clauses to guarantee a variety of protections: procedural due process (in civil and criminal proceedings); substantive due process (a guarantee of some fundamental rights); a prohibition against vague laws; incorporation of the Bill of Rights to state governments; and equal protection under the laws of the federal government.

U.S. Supreme Court in the context of John Marshall

John Marshall (September 24, 1755 – July 6, 1835) was an American statesman, jurist, and Founding Father who served as the fourth chief justice of the United States from 1801 until his death in 1835. He remains the longest-serving chief justice and fourth-longest-serving justice in the history of the U.S. Supreme Court, and he is widely regarded as one of the most influential justices ever to serve. Prior to joining the court, Marshall briefly served as both the U.S. Secretary of State under President John Adams and a U.S. Representative from Virginia, making him one of the few Americans to have held a constitutional office in each of the three branches of the United States federal government.

Marshall was born in Germantown in the Colony of Virginia in British America in 1755. After the outbreak of the American Revolutionary War, he joined the Continental Army, serving in numerous battles. During the later stages of the war, he was admitted to the state bar and won election to the Virginia House of Delegates. Marshall favored the ratification of the U.S. Constitution, and he played a major role in Virginia's ratification of that document. At the request of President Adams, Marshall traveled to France in 1797 to help bring an end to attacks on American shipping. In what became known as the XYZ Affair, the government of France refused to open negotiations unless the United States agreed to pay bribes. Upon his return from France, he led the Federalist Party in Congress. He was appointed secretary of state in 1800 after a cabinet shake-up, becoming an important figure in the Adams administration.
