A motion or vote of no confidence (or the inverse, a motion or vote of confidence) is a motion and corresponding vote thereon in a deliberative assembly (usually a legislative body) as to whether an officer (typically an executive) is deemed fit to continue to occupy their office. The no-confidence vote is a defining constitutional element of a parliamentary system, in which the government's/executive's mandate rests upon the continued support (or at least non-opposition) of the majority in the legislature. Systems differ in whether such a motion may be directed against the prime minister, against the government (this could be a majority government or a minority government/coalition government), against individual cabinet ministers, against the cabinet as a whole, or some combination of the above.

A censure motion is different from a no-confidence motion. In a parliamentary system, a vote of no confidence leads to the resignation of the prime minister and cabinet, or, depending on the constitutional procedure at hand, a snap election to potentially replace the government.

Hornsrud's Cabinet governed Norway between 28 January 1928 and 15 February 1928. The first Labour Party cabinet in Norway, it was defeated by the other parliamentary parties on a vote of no confidence after only sixteen days.

Vote of no confidence in the context of Confidence motions in the United Kingdom

In the United Kingdom, confidence motions are a means of testing the support of the government (executive) in a legislative body, and for the legislature to remove the government from office. A confidence motion may take the form of either a vote of confidence, usually put forward by the government, or a vote of no confidence (or censure motion), usually proposed by the opposition. When such a motion is put to a vote in the legislature, if a vote of confidence is defeated, or a vote of no confidence is passed, then the incumbent government must resign, or call a general election.

It is a fundamental principle of the British constitution that the government must retain the confidence of the legislature, as it is not possible for a government to operate effectively without the support of the majority of the people's representatives. At the national level, this means that the UK government (the Cabinet) must retain the confidence of a majority in the House of Commons.

Vote of no confidence in the context of Executive Council of the Irish Free State

The Executive Council (Irish: Ard-Chomhairle) was the cabinet and de facto executive branch of government of the 1922–1937 Irish Free State. Formally, executive power was vested in the Governor-General on behalf of the King. In practice, however, it was the Council that governed, since the Governor-General was (with few exceptions) bound to act on its advice. The Executive Council included a prime minister called the President of the Executive Council and a deputy prime minister called the vice-president. A member of the council was called an executive minister, as distinct from an extern minister who had charge of a department without being in the council.

The President of the Executive Council was appointed by the Governor-General after being nominated by Dáil Éireann, the lower house of the Oireachtas (parliament), and the remaining Executive Ministers were nominated by the President. The Executive Council could also be removed by a vote of no confidence in the Dáil.

Vote of no confidence in the context of Ministerial responsibility

In Westminster-style governments, individual ministerial responsibility is a constitutional convention that a cabinet minister bears the ultimate responsibility for the actions of their ministry or department. Individual ministerial responsibility is not the same as cabinet collective responsibility, which states members of the cabinet must approve publicly of its collective decisions or resign. This means that a Parliamentary motion for a vote of no confidence is not in order should the actions of an organ of government fail in the proper discharge of its responsibilities. Where there is ministerial responsibility, the accountable minister is expected to take the blame and ultimately resign, but the majority or coalition within parliament of which the minister is part, is not held to be answerable for that minister's failure.

This means that if waste, corruption, or any other misbehaviour is found to have occurred within a ministry, the minister is responsible even if the minister had no knowledge of the actions. A minister is ultimately responsible for all actions by a ministry because, even without knowledge of an infraction by subordinates, the minister approved the hiring and continued employment of those civil servants. If misdeeds are found to have occurred in a ministry, the minister is expected to resign. It is also possible for a minister to face criminal charges for malfeasance under their watch.

Vote of no confidence in the context of Elections in New Zealand

New Zealand is a representative democracy in which members of the unicameral New Zealand Parliament gain their seats through elections. General elections are usually held every three years; they may be held at an earlier date (a "snap" election) at the discretion of the prime minister (advising the governor-general), but that usually only happens in the event of a vote of no confidence or other exceptional circumstances. A by-election is held to fill an electorate vacancy arising during a parliamentary term. Election day is always a Saturday, but advance voting is allowed in the lead-up to it. The most recent general election took place on 14 October 2023.

New Zealand has a multi-party system due to proportional representation. The introduction of the mixed-member proportional (MMP) voting system in 1993 was the most significant change to the electoral system in the 20th century. The Electoral Commission is responsible for the administration of parliamentary elections. The introduction of MMP has led to mostly minority or coalition governments, but the first party to win an outright majority since the introduction of MMP was the Labour Party, led by Jacinda Ardern, in 2020.
