The Dáil Courts (also known as Republican Courts) were the judicial branch of government of the Irish Republic, which had unilaterally declared independence in 1919. They were formally established by a decree of the First Dáil on 29 June 1920, replacing more limited Arbitration Courts that had been authorised a year earlier. The Dáil Courts were an integral part of the Irish Republic's policy of undermining British rule in Ireland by establishing a monopoly on the legitimate use of force. They continued in operation until shortly into the life of the Irish Free State, which was established on 6 December 1922, after the approval of the Anglo-Irish Treaty.

There were two governments of the 2nd Dáil, which were ministries of Dáil Éireann, the assembly of Dáil Éireann that was the legislature of the Irish Republic, a unilaterally declared state which lasted from 1919 to 1922. The Second Dáil was elected at the 1921 Irish elections on 24 May 1921. The 3rd ministry (26 August 1921 – 9 January 1922) was led by Éamon de Valera as president and lasted 136 days. De Valera resigned as president after the Dáil voted to accept the Anglo-Irish Treaty. The 4th ministry (10 January – 9 September 1922) was led by Arthur Griffith as president. Griffith died in office on 12 August 1922, but a new Dáil ministry was not formed until 9 September 1922. Griffith served 214 days as president, with a further 28 days between his death and the appointment of W. T. Cosgrave as his successor by the Dáil.

The provisional government of Ireland, established under the terms of the Treaty, overlapped with the later period of ministries of Dáil Éireann. The 1st provisional government was led by Michael Collins as Chairman of the Provisional Government from 16 January 1922 until his death on 22 August 1922. On 25 August 1922, W. T. Cosgrave was appointed as his successor, with the other members of the new provisional government appointed on 30 September. The 1st provisional government lasted 218 days from the appointment of Collins until his death, with three days elapsing until the appointment of Cosgrave as his successor.

Unilateral declaration of independence in the context of Declaration of Independence of the Turkish Republic of Northern Cyprus

The declaration of Independence of the Turkish Republic of Northern Cyprus was a unilateral declaration of independence (UDI) from the Republic of Cyprus by the Turkish Cypriot parliament on 15 November 1983.

Eight years after the Turkish Federated State of Cyprus was proclaimed (in 1975), the declaration of North Cyprus was presented to the Turkish Cypriot parliament in North Nicosia by Turkish Cypriot Leader and Northern Cypriot State President Rauf Denktaş on 15 November 1983. Containing text espousing human rights and a desire to live side-by-side with the Greek Cypriot population, it ended with a declaration that Northern Cyprus was an independent and sovereign state, naming the entity the Turkish Republic of Northern Cyprus (TRNC). The Turkish Cypriot Parliament passed a unanimous resolution later that day ratifying the declaration.

Unilateral declaration of independence in the context of Advisory opinion on Kosovo's declaration of independence

Accordance with International Law of the Unilateral Declaration of Independence in Respect of Kosovo was a request in 2008 for an advisory opinion referred to the International Court of Justice by the United Nations General Assembly regarding the 2008 Kosovo declaration of independence. The territory of Kosovo is the subject of a dispute between Serbia and the Republic of Kosovo established by the declaration. This was the first case regarding a unilateral declaration of independence to be brought before the court.

The court delivered its advisory opinion on 22 July 2010; by a vote of 10 to 4, it declared that "the adoption of the declaration of independence of 17 February 2008 did not violate general international law because international law contains no 'prohibition on declarations of independence', nor did the adoption of the declaration of independence violate UN Security Council Resolution 1244, since this did not describe Kosovo's final status, nor had the Security Council reserved for itself the decision on final status." Reactions to the decision were mixed, with most countries which already recognised Kosovo hailing the decision and saying it was "unique" and does not set a precedent; while many countries which do not recognise Kosovo said they would not be doing so as such recognition could set a precedent of endorsing secession in other places.

Unilateral declaration of independence in the context of President of Dáil Éireann

The president of Dáil Éireann (Irish: Príomh aire [ˌpʲɾʲiːw ˈaɾʲə]), later also president of the Irish Republic, was the leader of the revolutionary Irish Republic of 1919–1922. The office was created in the Dáil Constitution adopted by Dáil Éireann, the parliament of the Republic, at its first meeting in January 1919. This provided that the president was elected by the Dáil as head of a cabinet called the Ministry of Dáil Éireann. During this period, Ireland was deemed by Britain to be part of the United Kingdom of Great Britain and Ireland, but the Irish Republic had made a unilateral Declaration of Independence on 21 January 1919. On 6 December 1922, after the ratification of the Anglo-Irish Treaty, the Irish Free State was recognised by Britain as a sovereign state, and the position of the president of Dáil Éireann was replaced by that of president of the Executive Council of the Irish Free State but, as a Dominion of the British Empire, the British monarch was head of state until the dominion status was rescinded in 1949.

Unilateral declaration of independence in the context of Kosovo precedent

On 17 February 2008, the majority of members of the Assembly of Kosovo, including Hashim Thaçi, and Fatmir Sejdiu (who were not members of the Assembly), not acting in the capacity of PISG, declared Kosovo an independent and sovereign state. Kosovo was soon recognized as a sovereign state by the United States, Turkey, Albania, Austria, Germany, Italy, France, the United Kingdom, the Republic of China (Taiwan), and others. This triggered an international debate over whether Kosovo's unilateral declaration of independence had set a precedent in international law that could apply to other separatist movements, or whether it is a special case. The recognition of Kosovo's independence by 101 out of 193 UN states, according to many sources, has given fresh impetus to other separatist movements.

It is estimated that a total of 70 unrecognized nations and organizations use the Kosovo precedent to achieve their goals. Abkhazia and South Ossetia renewed their calls for the recognition of their sovereignty. Kosovo's independence also led to increased tensions in Bosnia and Herzegovina, where the Republika Srpska vetoed recognising Kosovo, and threatened to declare independence themselves.

Unilateral declaration of independence in the context of Democratic Republic of East Timor (1975)

The Democratic Republic of East Timor (Portuguese: República Democrática de Timor-Leste, Tetum: Repúblika Demokrátika de Timór-Lorosa'e), or simply East Timor or Timor-Leste (Portuguese: Timor-Leste, Tetum: Timór-Lorosa'e) was a state that was unilaterally proclaimed on the territory of present-day Timor-Leste on 28 November 1975 by Fretilin prior to the Indonesian invasion of East Timor nine days later on 7 December 1975.

Its sovereignty was recognised by a small number of states, before it was invaded and subsequently annexed by Indonesia on 17 July 1976. Following continued resistance and growing international pressure, Timor-Leste became independent on 20 May 2002.

Unilateral declaration of independence in the context of East Timor independence

Timor is an island in South East Asia. Geologically considered a continental crustal fragment, it lies alongside the Sunda shelf, and is the largest in a cluster of islands between Java and New Guinea. European colonialism has shaped Timorese history since 1515, a period when it was divided between the Dutch in the west of the island (now Indonesian West Timor) and the Portuguese in the east (now the independent state of East Timor).A year after the April 25 Revolution, Portugal consecrated freedom to its overseas provinces. Under conditions of destabilization, propaganda and military pressure from Indonesia, Fretilin finally proclaimed the independence of the Democratic Republic of East Timor on 28 November 1975 with Xavier do Amaral as President and Nicolau Lobato as Prime Minister.

A few days after the proclamation, UDT and three other smaller parties announced the 'Balibo Declaration' - a call calling for the Indonesian government to annex East Timor. Even though it is called the Balibo Declaration, witnesses who signed it testified that the draft declaration was drafted in Jakarta and signed at a hotel in Bali under conditions of coercion as recorded in the report of the Commission for Reception, Truth and Reconciliation for Timor-Leste (CAVR) in 2005.
