Raphael Lemkin (Polish: Rafał Lemkin; 24 June 1900 – 28 August 1959) was a Polish lawyer who is known for coining the term "genocide" and for campaigning to establish the Genocide Convention, which legally defines the act. Following the German invasion of Poland in 1939, he fled the country and sought asylum in the United States, where he became an academic at Duke University and campaigned vigorously to raise international awareness of the atrocities that the Axis powers were committing across occupied Europe. It was amidst this environment of World War II that Lemkin coined the term "genocide" to describe Nazi Germany's extermination policy.

As a young Jewish law student who was deeply conscious of antisemitism and the persecution of Jews, Lemkin learned about the Ottoman genocide of the Armenian people during World War I and was deeply disturbed by the absence of international provisions to charge, punish, and hold accountable those who were responsible for organizing and executing it. In his view, the suffering of the Jewish people was part of a larger pattern of like-minded atrocities occurring around the world and throughout history, such as the Holodomor.

Genocide is the destruction of a people through targeted violence.

The concept of genocide was invented by Polish-Jewish lawyer Raphael Lemkin in the early 1940s; Lemkin viewed it broadly as the replacement of the victims' culture with that of their oppressor. Lemkin lobbied for genocide to be outlawed by an international treaty, but the Genocide Convention restricted the definition of genocide to five specific acts "committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such". Its definition remains contested by scholars and institutions across international law, history, sociology and related fields.

Raphael Lemkin in the context of Genocide of indigenous peoples

The genocide of indigenous peoples, colonial genocide, or settler genocide is the elimination of indigenous peoples as a part of the process of colonialism.

According to certain genocide experts, including Raphael Lemkin – who coined the term – colonialism is intimately connected with genocide. Lemkin saw genocide as a two-stage process: (1) the destruction of the targeted group's way of life, followed by (2) the perpetrators' imposition of their own national pattern. Other scholars view genocide as associated with but distinct from settler colonialism. The expansion of various Western European colonial powers such as the British and Spanish empires and the subsequent establishment of colonies on indigenous territories frequently involved acts of genocidal violence against indigenous groups in Europe, the Americas, Africa, Asia, and Oceania.

Cultural genocide or culturicide is a concept first described by Polish lawyer Raphael Lemkin in 1944, in the same book that coined the term genocide. The destruction of culture was a central component in Lemkin's formulation of genocide. The precise definition of cultural genocide remains contested, and the United Nations does not include it in the definition of genocide used in the 1948 Genocide Convention. The Armenian genocide Museum defines culturicide as "acts and measures undertaken to destroy nations' or ethnic groups' culture through spiritual, national, and cultural destruction", which appears to be essentially the same as ethnocide. Some ethnologists, such as Robert Jaulin, use the term ethnocide as a substitute for cultural genocide, although this usage has been criticized as risking the confusion between ethnicity and culture. Cultural genocide and ethnocide have in the past been used in distinct contexts. Cultural genocide without ethnocide is conceivable when a distinct ethnic identity is kept, but distinct cultural elements are eliminated.

Culturicide involves the eradication and destruction of cultural artifacts, such as books, artworks, and structures. The issue is addressed in multiple international treaties, including the Geneva Conventions and the Rome Statute, which define war crimes associated with the destruction of culture. Cultural genocide may also involve forced assimilation, as well as the suppression of a language or cultural activities that do not conform to the destroyer's notion of what is appropriate. Among many other potential reasons, cultural genocide may be committed for religious motives (e.g., iconoclasm which is based on aniconism); as part of a campaign of ethnic cleansing in an attempt to remove the evidence of a people from a specific locale or history; as part of an effort to implement a Year zero, in which the past and its associated culture is deleted and history is "reset". The drafters of the 1948 Genocide Convention initially considered using the term, but later dropped it from inclusion. The term "cultural genocide" has been considered in various draft United Nations declarations, but it is not used by the UN Genocide Convention.

The Convention on the Prevention and Punishment of the Crime of Genocide (CPPCG), or the Genocide Convention, is an international treaty that criminalizes genocide and obligates state parties to pursue the enforcement of its prohibition. It was the first legal instrument to codify genocide as a crime and the first human rights treaty unanimously adopted by the United Nations General Assembly on 9 December 1948, during the third session of the United Nations General Assembly. The Convention entered into force on 12 January 1951 and has 153 state parties as of February 2025.

The Genocide Convention was conceived largely in response to World War II, which saw atrocities such as the Holocaust that lacked an adequate description or legal definition. Polish-Jewish lawyer Raphael Lemkin, who had coined the term genocide in 1944 to describe Nazi policies in occupied Europe and the Armenian genocide, campaigned for its recognition as a crime under international law. Lemkin also linked colonialism with genocide, mentioning colonial genocides outside of Europe in his writings. In a 1946 resolution, the General Assembly recognized genocide as an international crime and called for the creation of a binding treaty to prevent and punish its perpetration. Subsequent discussions and negotiations among UN member states resulted in the CPPCG.

Raphael Lemkin in the context of Genocides in history (World War I through World War II)

Genocide is the intentional destruction of a people in whole or in part. The term was coined in 1944 by Raphael Lemkin. It is defined in Article 2 of the Convention on the Prevention and Punishment of the Crime of Genocide (CPPCG) of 1948 as "any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial, or religious group, as such: killing members of the group; causing serious bodily or mental harm to members of the group; deliberately inflicting on the group's conditions of life, calculated to bring about its physical destruction in whole or in part; imposing measures intended to prevent births within the group; [and] forcibly transferring children of the group to another group."

The preamble to the CPPCG states that "genocide is a crime under international law, contrary to the spirit and aims of the United Nations and condemned by the civilized world", and it also states that "at all periods of history genocide has inflicted great losses on humanity." Genocide is widely considered to be the epitome of human evil, and has been referred to as the "crime of crimes". The Political Instability Task Force estimated that 43 genocides occurred between 1956 and 2016, resulting in 50 million deaths. The UNHCR estimated that a further 50 million had been displaced by such episodes of violence.

Raphael Lemkin in the context of Native American genocide in the United States

The destruction of Native American peoples, cultures, and languages has been characterized by some as genocide. Debates are ongoing as to whether the entire process or only specific periods or events meet the definitions of genocide. Many of these definitions focus on intent, while others focus on outcomes. Raphael Lemkin, who coined the term "genocide", considered the displacement of Native Americans by European settlers as a historical example of genocide. While description as genocide has found increasing acceptance within Indigenous and genocide studies, mainstream scholarship on US and Native American history has largely rejected it, preferring to describe it as ethnic cleansing or certain events as genocidal.

Historians have long debated the pre-European population of the Americas. In 2023, historian Ned Blackhawk suggested that Northern America's population (Including modern-day Canada and the United States) had halved from 1492 to 1776 from about 8 million people (all Native American in 1492) to under 4 million (predominantly white in 1776). Russell Thornton estimated that by 1800, some 600,000 Native Americans lived in the regions that would become the modern United States and declined to an estimated 250,000 by 1890 before rebounding.

Raphael Lemkin in the context of Causes of the Holodomor

The causes of the Holodomor, which was a famine in Soviet Ukraine during 1932 and 1933 that resulted in the death of around 3–5 million people, are the subject of scholarly and political debate, particularly surrounding the Holodomor genocide question. Soviet historians Stephen Wheatcroft and J. Arch Getty believe the famine was the unintended consequence of problems arising from Soviet agricultural collectivization which was designed to accelerate the program of industrialization in the Soviet Union under Joseph Stalin. Other academics conclude policies were intentionally designed to cause the famine. Some scholars and political leaders claim that the famine may be classified as a genocide under the definition of genocide that entered international law with the 1948 Genocide Convention.

Raphael Lemkin, the co-author of the United Nations Convention on the Prevention and Punishment of Genocide in 1948, considered Holodomor an attempt to destroy the Ukrainian nation, not just Ukrainian farmers. Such a conclusion was made by him based on four factors:
