The public domain (PD) consists of all the creative work to which no exclusive intellectual property rights apply. Those rights may have expired, be forfeit, waived or may be inapplicable. Because no one holds the exclusive rights, anyone can legally use or reference those works without permission.

As examples, the works of William Shakespeare, Ludwig van Beethoven, Miguel de Cervantes, Zoroaster, Lao Zi, Confucius, Aristotle, L. Frank Baum, Leonardo da Vinci and Georges Méliès are in the public domain either by virtue of their having been created before copyright existed, or by their copyright term having expired. Some works are not covered by a country's copyright laws, and are therefore in the public domain; for example, in the United States, items excluded from copyright include the formulae of Newtonian physics and cooking recipes. Other works are actively dedicated by their authors to the public domain (see waiver); examples include reference implementations of cryptographic algorithms. The term public domain is not normally applied to situations where the creator of a work retains residual rights, in which case use of the work is referred to as "under license" or "with permission".

Webster's Dictionary is any of the US English language dictionaries edited in the early 19th century by Noah Webster (1758–1843), a US lexicographer, as well as numerous related or unrelated dictionaries that have adopted the Webster's name in his honor. Public domain in the context of Behind the Screen

Behind the Screen is a 1916 American silent short comedy film written by, directed by, and starring Charlie Chaplin, and also starring Eric Campbell and Edna Purviance. Much of the film is slapstick comedy involving Chaplin manhandling large props, mishandling the control to a trap door, and engaging in a raucous pie-throwing fight which spills over into another studio where a period drama is being shot. In one scene Chaplin deftly carries 11 chairs over his back in his left hand and lifts a piano in his right hand.

Public domain in the context of Universal Newsreel

Universal Newsreel (sometimes known as Universal-International Newsreel or just U-I Newsreel) was a series of 7- to 10-minute newsreels that were released twice a week between 1929 and 1967 by Universal Studios. A Universal publicity official, Sam B. Jacobson, was involved in originating and producing the newsreels. Nearly all of them were filmed in black-and-white, and many were narrated by Ed Herlihy. From January 1919 to July 1929, Universal released International Newsreel, produced by Hearst's International News Service—this series later became Hearst Metrotone News released first by Fox Film Corporation 1929–1934 and then by Metro-Goldwyn-Mayer beginning in 1934.

In 1974, the films' owner, MCA, made the decision to donate all its edited newsreels and outtakes collection to the National Archives, without copyright restrictions. The decision effectively released the films into the public domain, although some stories may contain other underlying intellectual property or proprietary use rights. Because royalties no longer have to be paid in order to broadcast them, Universal Newsreels have become a popular source of file footage. The History Channel made them a key part of the TV series Year-By-Year. Also, C-SPAN and CNN regularly use the films for video of events that took place before those networks were founded. Nevertheless, much of the footage was lost in the 1978 National Archives vault fire which destroyed about 12.6 million feet of 35mm black and white negatives, or about 70% of the MCA-U donation. Most of the nitrate film was irreplaceable single-copy outtakes from WWII that had never been seen by the public.

The Encyclopædia Britannica Eleventh Edition (1910–1911) is a 29-volume reference work, an edition of the Encyclopædia Britannica. It was developed during the encyclopaedia's transition from a British to an American publication. Some of its articles were written by the best-known scholars of the time. This edition of the encyclopaedia, containing 40,000 entries, has entered the public domain and is readily available on the Internet. Its use in modern scholarship and as a reliable source has been deemed problematic due to the outdated nature of some of its content. Nevertheless, the 11th edition has retained considerable value as a time capsule of scientific and historical information, as well as scholarly attitudes of the era immediately preceding World War I.

King Kong is a 1933 American pre-Code adventure horror monster film directed and produced by Merian C. Cooper and Ernest B. Schoedsack, with special effects by Willis H. O'Brien and music by Max Steiner. Produced and distributed by RKO Radio Pictures, King Kong is the first film in the self-titled franchise, combining live action sequences with stop-motion animation using rear-screen projection. The idea for the film came when Cooper decided to create a motion picture about a giant gorilla struggling against modern civilization. The film stars Fay Wray, Robert Armstrong, and Bruce Cabot. The film follows a giant ape dubbed Kong who feels affection for a beautiful young woman offered to him as a sacrifice.

King Kong premiered in New York City on March 2, 1933, to many rave reviews, with praise for its stop-motion animation and musical score. During its initial run, the film earned a profit of $650,000, which increased to $2,847,000 by the time of its re-release in 1952. Various scenes were deleted by censors, and in 1970, they were restored. Later, in 1991, the film was deemed "culturally, historically and aesthetically significant" by the Library of Congress and selected for preservation in the National Film Registry. In 2010, the film was ranked by Rotten Tomatoes as the greatest horror film of all time and the fifty-sixth greatest film of all time. Various new editions of the film have also been released. A sequel, entitled Son of Kong, was made the same year as the original film, and several more films have been made, including two remakes in 1976 and 2005, respectively. The characters and story have since entered the public domain; the film's copyright is set to expire in 2029 in the US. Analysis of the film has included such topics as racial stereotypes, Ann's relationship with the other characters, and the struggle between nature and civilization.

Free content, libre content, libre information, or free information is any kind of creative work, such as a work of art, a book, a software program, or any other creative content for which there are very minimal copyright and other legal limitations on usage, modification and distribution. These are works or expressions which can be freely studied, applied, copied and modified by anyone for any purpose including, in some cases, commercial purposes. Free content encompasses all works in the public domain and also those copyrighted works whose licenses honor and uphold the definition of free cultural work.

In most countries, the Berne Convention grants copyright holders control over their creations by default. Therefore, copyrighted content must be explicitly declared free by the authors, which is usually accomplished by referencing or including licensing statements from within the work. The right to reuse such a work is granted by the authors in a license known as a free license, a free distribution license, or an open license, depending on the rights assigned. These freedoms given to users in the reuse of works (that is, the right to freely use, study, modify or distribute these works, possibly also for commercial purposes) are often associated with obligations (to cite the original author, to maintain the original license of the reused content) or restrictions (excluding commercial use, banning certain media) chosen by the author. There are a number of standardized licenses offering varied options that allow authors to choose the type of reuse of their work that they wish to authorize or forbid.

Stock photography is the supply of photographs that are often licensed for specific uses. The stock photo industry, which began to gain hold in the 1920s, has established models including traditional macrostock photography, midstock photography, and microstock photography. Conventional stock agencies charge from several hundred to several thousand US dollars per image, while microstock photography may sell for around US$0.25. Professional stock photographers traditionally place their images with one or more stock agencies on a contractual basis, while stock agencies may accept the high-quality photos of amateur photographers through online submission.

Themes for stock photos are diverse, although Megan Garber of The Atlantic wrote in 2012 that "one of the more wacky/wondrous elements of stock photos is the manner in which, as a genre, they've developed a unifying editorial sensibility. To see a stock image is... to know you're seeing a stock image." Historically notable traditional stock photo agencies have included RobertStock, the Bettman Archive in New York, and the Hulton Archive in the United Kingdom, among many others. In the 1990s companies such as Photodisc in Seattle, Washington, began selling CD ROMs with packs of images, pioneering the royalty-free licensing system at a time when Rights Managed licensing was the norm in the stock industry. There was a great amount of consolidation among stock photo agencies between 1990 and the mid-2000s, particularly through Corbis and Getty Images. The early microstock company iStockphoto was founded in May 2000, followed by companies such as Dreamstime, 123RF, Shutterstock, DepositPhotos and Adobe Stock.

Public domain in the context of Science and technology in the United States

Science and technology in the United States has a long history, producing many important figures and developments in the field. The United States of America came into being around the Age of Enlightenment (1685 to 1815), an era in Western philosophy in which writers and thinkers, rejecting the perceived superstitions of the past, instead chose to emphasize the intellectual, scientific and cultural life, centered upon the 18th century, in which reason was advocated as the primary source for legitimacy and authority. Enlightenment philosophers envisioned a "republic of science," where ideas would be exchanged freely and useful knowledge would improve the lot of all citizens.

The United States Constitution itself reflects the desire to encourage scientific creativity. It gives the United States Congress the power "to promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries." This clause formed the basis for the U.S. patent and copyright systems, whereby creators of original art and technology would get a government granted monopoly, which after a limited period would become free to all citizens, thereby enriching the public domain.

Public domain in the context of Migrant Mother

Migrant Mother is a photograph taken in 1936 in Nipomo, California, by American photographer Dorothea Lange during her time with the Resettlement Administration (later the Farm Security Administration). The 28.3 by 21.8 cm (11 1/8 by 8 9/16 in) gelatin silver print depicts a mother anxiously gazing into the distance, with an infant in her lap and two older children huddling close by. The photo captures the plight of migrant farm workers who arrived in California en masse looking for employment during the Great Depression. Initially anonymous, the woman in the photo was identified as Florence Owens Thompson in 1978, following the work of a journalist for the California-based newspaper The Modesto Bee.

Since its publication, Lange's work has been considered symbolic of the Great Depression. It is in the public domain and has been widely reproduced in educational material, advertisements, and other media. Today, Migrant Mother is considered to be a part of the classic canon of American art and international photography. A print is housed at the Museum of Modern Art in New York City.

OpenStreetMap (OSM) is a map database maintained by a community of volunteers via open collaboration. Contributors collect data from surveys, trace from aerial photo imagery or satellite imagery, and import from other freely licensed geodata sources. OpenStreetMap is freely licensed under the Open Database License and is commonly used to make electronic maps, inform turn-by-turn navigation, and assist in humanitarian aid and data visualisation. OpenStreetMap uses its own data model to store geographical features which can then be exported into other GIS file formats. The OpenStreetMap website itself is an online map, geodata search engine, and editor.

OpenStreetMap was created by Steve Coast in response to the Ordnance Survey, the United Kingdom's national mapping agency, failing to release its data to the public under free licences in 2004. Initially, maps in OSM were created only via GPS traces, but it was quickly populated by importing public domain geographical data such as the U.S. TIGER and by tracing imagery as permitted by source. OpenStreetMap's adoption was accelerated by the development of supporting software and applications and Google Maps' 2012 introduction of pricing.

Science and Sanity: An Introduction to Non-Aristotelian Systems and General Semantics is a 1933 philosophy book written by Alfred Korzybski (1879–1950). Published by the Institute of General Semantics, it remains in print, the sixth edition released in 2023. It's considered Korzybski's magnum opus. It was by this book's influence that general semantics became known to the public. In some countries, the book is already in the public domain.

Public domain in the context of LibriVox

LibriVox is a group of worldwide volunteers who read and record public domain texts, creating free public domain audiobooks for download from their website and other digital library hosting sites on the internet. It was founded in 2005 by Hugh McGuire with the objective to "make all books in the public domain available, for free, in audio format on the internet."

On 6 August 2016, the completed projects numbered 10,000; on 14 February 2021 there were 15,000, and on 17 December 2024 the catalog reached 20,000 recordings. Most releases are in the English language, but many non-English works are also available. There are multiple affiliated projects that are providing additional content. LibriVox is associated with Project Gutenberg from where the project gets some of its texts, and the Internet Archive that hosts digital recordings.

Works are in the public domain if they are not covered by the intellectual property right known as copyright, or if the intellectual property rights to the works have expired. Works automatically enter the public domain when their copyright has expired. The United States Copyright Office is a federal agency tasked with maintaining copyright records.

All works (excepting sound recordings) first published or released in the United States before January 1, 1930, have lost their copyright protection 95 years later, effective January 1, 2025. In the same manner, works published in 1930 will enter the public domain as of January 1, 2026, and this cycle will repeat until works published in 2002 enter the public domain on January 1, 2098. Works of corporate authorship will continue to adhere to the 95-year term following the 2098 date. Under current copyright law, beginning in 2049, 1978 and beyond works by creators who died 70 years earlier will expire each year. For example, if a creator were to die in 2002, their works' copyright would last through the end of 2072 and enter the public domain on January 1, 2073.

Public domain in the context of Copyright status of work by the U.S. government

A work of the United States government is defined by the United States copyright law, as "a work prepared by an officer or employee of the United States Government as part of that person's official duties". Under section 105 of the Copyright Act of 1976, such works are not entitled to domestic copyright protection under U.S. law and are therefore in the public domain.

This act only applies to U.S. domestic copyright as that is the extent of U.S. federal law. The U.S. government asserts that it can still hold the copyright to those works in other countries.
