Maliki in the context of Muslim sects

Islamic schools and branches have different understandings of Islam. There are many different sects or denominations, schools of Islamic jurisprudence, and schools of Islamic theology, or ʿaqīdah (creed). Within Sunnī Islam, there may be differences, such as different orders (tariqa) within Sufism, different schools of theology (Atharī, Ashʿarī, Māturīdī) and jurisprudence (Ḥanafī, Mālikī, Shāfiʿī, Ḥanbalī). Groups in Islam may be numerous (Sunnīs make up 87-90% of all Muslims), or relatively small in size (Ibadis, Ismāʿīlīs, Zaydīs).

Differences between the groups may not be well known to Muslims outside of scholarly circles, or may have induced enough passion to have resulted in political and religious violence (Barelvism, Deobandism, Salafism, Wahhabism). There are informal movements driven by ideas (such as Islamic modernism and Islamism), as well as organized groups with governing bodies (such as Nation of Islam). Some of the Islamic sects and groups regard certain others as deviant or not being truly Muslim (for example, Sunnīs frequently discriminate against Ahmadiyya, Alawites, Quranists, and sometimes Shīʿas). Some Islamic sects and groups date back to the early history of Islam between the 7th and 9th centuries CE (Kharijites, Mu'tazila, Sunnīs, Shīʿas), whereas others have arisen much more recently (Islamic neo-traditionalism, liberalism and progressivism, Islamic modernism, Salafism and Wahhabism), or even in the 20th century (Nation of Islam). Still others were influential historically, but are no longer in existence (non-Ibadi Kharijites and Murji'ah).

Maliki in the context of Six Books

Kutub al-Sittah (Arabic: ٱلْكُتُب ٱلسِّتَّة, romanizedal-Kutub al-Sitta, lit.'the Six Books'), also known as al-Sihah al-Sitta (Arabic: الصحاح الستة, romanizedal-Ṣiḥāḥ al-Sitta, lit.'the Authentic Six') are the six canonical hadith collections of Sunni Islam. They were all compiled in the 9th and early 10th centuries, roughly from 840 to 912 CE and are thought to embody the Sunnah of Muhammad.

The books are the Sahih of al-Bukhari (d. 870), the Sahih of Muslim ibn al-Hajjaj (d. 875), the Sunan of Abu Dawud (d. 889), the Sunan of al-Tirmidhi (d. 892), the Sunan of al-Nasa'i (d. 915), and the Sunan of Ibn Majah (d. 887 or 889) as the sixth book, though some (particularly the Malikis and Ibn al-Athir) instead listed the Muwatta of Malik ibn Anas (d. 795) as the sixth book, and other scholars list Sunan of al-Daraqutni (d. 995) as the sixth book. Sunan ibn Majah largely won out as the sixth canonical book because its content has less overlap with the other five compared with its two contenders.

Maliki in the context of Istihsan

Istiḥsān (Arabic: ‏اِسْتِحْسَان[is.tiːħ.saːn]) is an Arabic term for juristic discretion. In its literal sense it means "to consider something good". Muslim scholars may use it to express their preference for particular judgements in Islamic law over other possibilities. It is one of the principles of legal thought underlying scholarly interpretation or ijtihad.

A number of disputes existed amongst the classical jurists over this principle with the Hanafi school of jurisprudence and its jurists (fuqahah) adopting this as a secondary source. It is not the same thing as istislah, which plays a prominent part in other schools, including Maliki school, or istihlal, which is a derisive term for deeming something forbidden as permissible.

Maliki in the context of Hanbali school

The Hanbali school or Hanbalism is one of the four major schools of Islamic jurisprudence, belonging to the Ahl al-Hadith tradition within Sunni Islam. It is named after and based on the teachings of the 9th-century scholar, jurist and traditionist, Ahmad ibn Hanbal (c. 780–855 CE), and later institutionalized by his students. One who subscribes to the Hanbali school is called a Hanbali (Arabic: ٱلْحَنْبَلِيّ, romanizedal-ḥanbalī, pl. ٱلْحَنْبَلِيَّة, al-ḥanbaliyya, or ٱلْحَنَابِلَة, al-ḥanābila). It mostly adheres to the Athari school of theology and is the smallest out of the four major Sunni schools, the others being the Hanafi, Maliki and Shafi'i schools.

Like the other Sunni schools, it primarily derives sharia from the Quran, hadith and views of Muhammad's companions. In cases where there is no clear answer in the sacred texts of Islam, the Hanbali school does not accept juristic discretion or customs of a community as sound bases to derive Islamic law on their own—methods that the Hanafi and Maliki schools accept. Hanbalis are the majority in Saudi Arabia and Qatar where the Salafi movement has grown. As such, Hanbalis form barely 5% of the Sunni Muslim population worldwide.

Maliki in the context of Malikism

The Maliki school or Malikism is one of the four major schools of Islamic jurisprudence within Sunni Islam. It was founded by Malik ibn Anas (c. 711–795 CE) in the 8th century. In contrast to the Ahl al-Hadith and Ahl al-Ra'y schools of thought, the Maliki school takes a unique position known as Ahl al-Amal, in which they consider the Sunnah to be primarily sourced from the practice of the people of Medina and living Islamic traditions for their rulings on Islamic law.

The Maliki school is one of the largest groups of Sunni Muslims, comparable to the Shafi’i madhhab in adherents, but smaller than the Hanafi madhhab. Sharia based on Maliki Fiqh is predominantly found in North Africa (excluding parts of Egypt), West Africa, Chad, Sudan and the Persian Gulf.

Maliki in the context of Shafi'ism

The Shafi'i school or Shafi'i Madhhab (Arabic: ٱلْمَذْهَب ٱلشَّافِعِيّ, romanizedal-madhhab al-shāfiʿī) or Shafi'i is one of the four major schools of Islamic jurisprudence, belonging to the Ahl al-Hadith tradition within Sunni Islam. It was founded by the Muslim scholar, jurist, and traditionist al-Shafi'i (c. 767–820 CE), "the father of Muslim jurisprudence", in the early 9th century.

The other three schools of Sunnī jurisprudence are Ḥanafī, Mālikī and Ḥanbalī. Like the other schools of fiqh, Shafiʽi recognize the First Four Caliphs as the Islamic prophet Muhammad's rightful successors and relies on the Qurʾān and the "sound" books of Ḥadīths as primary sources of law. The Shafi'i school affirms the authority of both divine law-giving (the Qurʾān and the Sunnah) and human speculation regarding the Law. Where passages of Qurʾān and/or the Ḥadīths are ambiguous, the school seeks guidance of Qiyās (analogical reasoning). The Ijmā' (consensus of scholars or of the community) was "accepted but not stressed". The school rejected the dependence on local traditions as the source of legal precedent and rebuffed the Ahl al-Ra'y (personal opinion) and the Istiḥsān (juristic discretion).

Maliki in the context of Culture of Western Sahara

The people of Western Sahara speak the Ḥassānīya dialect of Arabic, also spoken in northern Mauritania, and Spanish. They are of mixed Arab, African (including Berber descent), many consider themselves to be Arab. Most claim that they descend from the tribe called Beni Hassan, an Arab tribe, who immigrated to the Western Saharan desert in the 14th century. The Sahrawis are Sunni Muslim and follow the Maliki law school. Their interpretation of Islam has traditionally being quite liberal and adapted to nomad life (i.e. generally functioning without mosques).

The clan- and tribe-based society underwent a massive social upheaval in 1975, when a large portion of the population fled fighting in the country and settled in the refugee camps of Tindouf, Algeria, breaking up families and clans. The Polisario Front, which runs the camps, has attempted to modernize their society, placing a public emphasis on education, the eradication of tribalism and the emancipation of women. The role of women in camps was enhanced by their shouldering of the main responsibility for the camps and government bureaucracy during the war years, as virtually the entire male population was enrolled in the Polisario army.

Maliki in the context of Shafi'i school
