A fugitive or runaway is a person who is fleeing from custody, whether it be from jail, a government arrest, government or non-government questioning, vigilante violence, or outraged private individuals. A fugitive from justice, also known as a wanted person, can be a person who is either convicted or accused of a crime and hiding from law enforcement in the state or taking refuge in a different country in order to avoid arrest.

A fugitive from justice alternatively has been defined as a person formally charged with a crime or a convicted criminal whose punishment has not yet been determined or fully served who is currently beyond the custody or control of the national or sub-national government or international criminal tribunal with an interest in their arrest. This latter definition adopts the perspective of the pursuing government or tribunal, recognizing that the charged (versus escaped) individual does not necessarily realize that they are officially a wanted person (e.g., due to a case of mistaken identity or reliance on a sealed indictment), and therefore may not be fleeing, hiding, or taking refuge to avoid arrest. The fugitive from justice is ‘international’ (versus ‘domestic’) if wanted by law enforcement authorities across a national border.Interpol is the international organization with no legal authority to directly pursue or detain fugitives of any kind. Europol is the European authority for the pursuit of fugitives who are on the run within Europe, and coordinates their search, while national authorities in the probable country of their stay coordinate their arrest. In the United States, the U.S. Marshals Service is the primary law enforcement agency that tracks down federal fugitives, though the Federal Bureau of Investigation also tracks fugitives.

The seven institutions of the European Union (EU) are seated in four different cities, which are Brussels (Belgium), Frankfurt am Main (Germany), Luxembourg (Luxembourg) and Strasbourg (France), rather than being concentrated in a single capital city. The EU agencies and other bodies are located all across the union, but usually not fixed in the treaties. The Hague is the only exception, as the fixed seat of the Agency for Law Enforcement Cooperation (Europol). Luxembourg City is the EU capital that can lay claim to having the most of the seven EU institutions based wholly or partly upon its territory, with only the European Council and European Central Bank not having a presence in the city. Over the years, Brussels has become the EU's political hub, with the College of the Commissioners — the European Commission's politically accountable executive — and the European Council both meeting at their Brussels-based headquarters, and the European Parliament and Council of the EU holding the majority of their meetings annually within the city. This has led media to describe it as the de facto "capital of the EU."

The seats have been a matter of political dispute since the states first failed to reach an agreement at the establishment of the European Coal and Steel Community in 1952. However, a final agreement between member states was reached in 1992, and later attached to the Treaty of Amsterdam.

Europol in the context of National Crime Agency

The National Crime Agency (NCA) is a national law enforcement agency in the United Kingdom. It is the UK's lead agency against organised crime; human, weapon and drug trafficking; cybercrime; and economic crime that goes across regional and international borders, but it can be tasked to investigate any crime. The NCA has a strategic role as part of which it looks at serious crime in aggregate across the UK, especially analysing how organised criminals are operating and how they can be disrupted. To do this, it works closely with regional organised crime units (ROCUs), local police forces, and other government departments and agencies. It is not a police force as such, but many of its employees do have the power of a constable.

It is the UK's point of contact for foreign agencies such as Interpol, Europol and other international law enforcement agencies. On a day-to-day basis, the NCA assists police forces and other law enforcement agencies (and vice versa) under voluntary assistance arrangements. In extremis, the NCA Director General has the power to direct a chief officer of a police force to give directed assistance with NCA tasks where necessary (but only with consent of the relevant Secretary of State). The NCA itself can also be directed by the Secretary of State to give directed assistance to a police force or other law enforcement agency.

Europol in the context of 2015 Danish European Union opt-out referendum

A referendum on one of the country's opt-outs from the European Union was held in Denmark on 3 December 2015. Specifically, the referendum was on whether to convert Denmark's current full opt-out on home and justice matters into an opt-out with case-by-case opt-in similar to those held by Ireland and the United Kingdom. Approval of the referendum was needed for Denmark to remain in Europol under the new rules. However, it was rejected by 53% of voters.
