The encomienda (Spanish pronunciation: [eŋkoˈmjenda] , lit.'entrusting') was a 16th-century Spanish labour system that rewarded Spain's conquistadors with the labour of conquered non-Christian peoples. In theory, the conquerors provided the labourers with benefits, including military protection and education. In practice, the conquered were subject to conditions that closely resembled instances of forced labour and slavery. The encomienda was first established in Spain following the Christian Reconquista, and it was applied on a much larger scale during the Spanish colonization of the Americas and the Spanish East Indies. Conquered peoples were considered vassals of the Spanish monarch. The Crown awarded an encomienda as a grant to a particular individual. In the conquest era of the early sixteenth century, the grants were considered a monopoly on the labour of particular groups of indigenous peoples, held in perpetuity by the grant holder, called the encomendero; starting from the New Laws of 1542, the encomienda ended upon the death of the encomendero, and was replaced by the repartimiento.

Encomiendas devolved from their original Iberian form into a form of communal slavery. In the encomienda, the Spanish Crown granted a person a specified number of natives from a specific community but did not dictate which individuals in the community would have to provide their labour. Indigenous leaders were charged with mobilising the assessed tribute and labour. In turn, encomenderos were to ensure that the encomienda natives were given instruction in Catholicism and the Spanish language, to protect them from warring tribes or pirates; to suppress rebellion against Spaniards, and maintain infrastructure. The natives provided tributes in the form of metals, maize, wheat, pork, and other agricultural products.

Hernán Cortés de Monroy y Pizarro Altamirano, 1st Marquis of the Valley of Oaxaca (December 1485 – 2 December 1547) was a Spanish conquistador who led an expedition that caused the fall of the Aztec Empire and brought large portions of what is now mainland Mexico under the rule of the King of Castile in the early 16th century. Cortés was part of the generation of Spanish explorers and conquistadors who began the first phase of the Spanish colonization of the Americas.

Born in Medellín, Spain, to a family of lesser nobility, Cortés chose to pursue adventure and riches in the New World. He went to Hispaniola and later to Cuba, where he received an encomienda (the right to the labour of certain subjects). For a short time, he served as alcalde (magistrate) of the second Spanish town founded on the island. In 1519, he was elected captain of the third expedition to the mainland, which he partly funded. His enmity with the governor of Cuba, Diego Velázquez de Cuéllar, resulted in the recall of the expedition at the last moment, an order which Cortés ignored.

Encomienda in the context of Slavery in the Spanish New World colonies

Slavery in the Spanish American viceroyalties included the enslavement, forced labor and peonage of indigenous peoples, Africans, and Asians from the late 15th to late 19th century, and its aftereffects in the 20th and 21st centuries. The economic and social institution of slavery existed throughout the Spanish Empire, including Spain itself. Initially, indigenous people were subjected to the encomienda system until the 1543 New Laws that prohibited it. This was replaced with the repartimiento system. Africans were also transported to the Americas for their labor under the race-based system of chattel slavery. Later, Southeast Asian people were brought to the Americas under forms of indenture and peonage to provide cheap labor to replace enslaved Africans.

People had been enslaved in what is now Spain since the times of the Roman Empire. Conquistadors were awarded with indigenous forced labor and tribute for participating in the conquest of Americas, known as encomiendas. Following the collapse of indigenous populations in the Americas, the Spanish restricted the forced labor of Native Americans with the Laws of Burgos of 1512 and the New Laws of 1542. Instead, the Spanish increasingly utilized enslaved people from West and Central Africa for labor on commercial plantations, as well as urban slavery in households, religious institutions, textile workshops (obrajes), and other venues. As the Crown barred Spaniards from directly participating in the Atlantic slave trade, the right to export slaves (the Asiento de Negros) was a major foreign policy objective of other European powers, sparking numerous European wars such as the War of Spanish Succession and the War of Jenkins' Ear. Spanish colonies ultimately received around 22% of all the Africans delivered to American shores. Towards the end of the Atlantic slave trade, Asian migrant workers (chinos and coolies) in colonial Mexico and Cuba were subjected to peonage and harsh labor under exploitative contracts of indenture.

Encomienda in the context of Arauco War

The Arauco War was a long-running conflict between colonial Spaniards and the Mapuche people, mostly fought in the Araucanía region of Chile. The conflict began at first as a reaction to the Spanish conquerors attempting to establish cities and force Mapuches into servitude. It subsequently evolved over time into phases comprising drawn-out sieges, slave-hunting expeditions, pillaging raids, punitive expeditions, and renewed Spanish attempts to secure lost territories. Abduction of women and war rape was common on both sides.

The Spaniards penetrated into Mapuche territory during the conquest of Chile until the Battle of Curalaba in 1598 and the following destruction of the Seven Cities led to the establishment of a clear frontier between the Spanish domains and the land of the independent Mapuche. From the 17th to the late 18th century a series of parliaments were held between royal governors and Mapuche lonkos and the war devolved to sporadic pillaging carried out by both sides.

Encomienda in the context of Land reform in Mexico

Before the 1910 Mexican Revolution, most land in post-independence Mexico was owned by wealthy Mexicans and foreigners, with small holders and indigenous communities possessing little productive land. During the colonial era, the Spanish crown protected holdings of indigenous communities that were mostly engaged in subsistence agriculture to countervail the encomienda and repartimiento systems. In the 19th century, Mexican elites consolidated large landed estates (haciendas) in many parts of the country while small holders, many of whom were mixed-race mestizos, engaged with the commercial economy.

After the War of Independence, Mexican liberals sought to modernize the economy, promoting commercial agriculture through the dissolution of common lands, most of which were then property of the Catholic Church, and indigenous communities. When liberals came to power in the mid nineteenth century, they implemented laws that mandated the breakup and sale of these corporate lands. When liberal general Porfirio Díaz took office in 1877, he embarked on a more sweeping program of modernization and economic development. His land policies sought to attract foreign investment to Mexican mining, agriculture, and ranching, resulting in Mexican and foreign investors controlling the majority of Mexican territory by the outbreak of the Mexican Revolution in 1910. Peasant mobilization against landed elites during the revolution prompted land reform in the post-revolutionary period and led to the creation of the ejido system, enshrined in the Mexican Constitution of 1917.

Encomienda in the context of New Laws

The New Laws (Spanish: Leyes Nuevas), also known as the New Laws of the Indies for the Good Treatment and Preservation of the Indians, were issued on November 20, 1542, by Charles V, Holy Roman Emperor (King Charles I of Spain) and regard the Spanish colonization of the Americas. Following denunciations and calls for reform from individuals, such as the Dominican friar Bartolomé de Las Casas, these laws were intended to prevent the exploitation and mistreatment of the indigenous peoples of the Americas by the encomenderos, by limiting their power and dominion over groups of natives.

Blasco Núñez Vela, the first Viceroy of Peru, enforced the New Laws. He was opposed by a revolt of encomenderos and was killed in 1546 by the landowning faction led by Gonzalo Pizarro. Pizarro wanted to maintain a political structure built upon the Incan model the Spanish found in place. Although the New Laws were only partly successful, due to the opposition of colonists, they did result in the liberation of thousands of indigenous workers, who had been held in a state of semi-slavery.

Encomienda in the context of Laws of Burgos

The Laws of Burgos (Spanish: Leyes de Burgos), promulgated on 27 December 1512 in Burgos, Crown of Castile (Spain), was the first codified set of laws governing the behavior of Spaniards in the Americas, particularly with regard to the Indigenous people of the Americas ("native Caribbean Indians"). They forbade the slavery of the indigenous people and endorsed their conversion to Catholicism. The laws were created following the conquest and Spanish colonization of the Americas in the West Indies, where the common law of Castile was not fully applicable. Friars and Spanish academics pressured King Ferdinand II of Aragon and his daughter, Queen regnant, Joanna of Castile, to pass the set of laws in order to protect the rights of the natives of the New World.

The scope of the laws was originally restricted to the island of Hispaniola but was later extended to the islands of Puerto Rico and Santiago, later renamed Jamaica. These laws authorized and legalized the colonial practice of creating encomiendas, where Indians were grouped together to work under a colonial head of the estate for a salary, and limited the size of these establishments to between 40 and 150 people. They also established a minutely regulated regime of work, pay, provisioning, living quarters, and diet. Women more than four months pregnant were exempted from heavy labor.

Encomienda in the context of Bartolomé de las Casas

Bartolomé de las Casas, OP (US: /lɑːs ˈkɑːsəs/ lahss KAH-səss; Spanish pronunciation: [baɾtoloˈme ðe las ˈkasas]); 11 November 1484 – 18 July 1566) was a Spanish lawyer, clergyman, writer, and activist best known for his work as a historian and social reformer. He arrived in Hispaniola as a layman, then became a Dominican friar. He was appointed as the first resident Bishop of Chiapas, and the first officially appointed "Protector of the Indians". His extensive writings, the most famous being A Short Account of the Destruction of the Indies and Historia de Las Indias, chronicle the first decades of colonization of the Caribbean islands. He described and railed against the atrocities committed by the conquistadores against the Indigenous peoples.

Arriving as one of the first Spanish settlers in the Americas, Las Casas initially participated in the colonial economy built on forced Indigenous labor, but eventually felt compelled to oppose the abuses committed by European colonists against the Indigenous population. In 1515 he gave up his Native American laborers and encomienda. He then advocated, before Charles V, on behalf of rights for the natives. In his early writings, he advocated the use of African slaves to replace Indigenous labor. He did so without knowing that the Portuguese were carrying out "brutal and unjust wars in the name of spreading the faith". Later in life, he retracted this position, as he regarded both forms of slavery as equally wrong.
