A concordat (French pronunciation: [kɔ̃kɔʁda]) is a convention between the Holy See and a sovereign state that defines the relationship between the Catholic Church and the state in matters that concern both, i.e. the recognition and privileges of the Catholic Church in a particular country and with secular matters that affect church interests.

According to P. W. Brown the use of the term "concordat" does not appear "until the pontificate of Pope Martin V (1413–1431) in a work by Nicholas de Cusa, entitled De Concordantia Catholica. The first concordat dates from 1098, and from then to the beginning of the First World War the Holy See signed 74 concordats. Due to the substantial remapping of Europe that took place after the war, new concordats with legal successor states were necessary. The post–World War I era saw the greatest proliferation of concordats in history.

The Constitutional Agreement between the Georgian state and the Apostolic Autocephalous Orthodox Church of Georgia (Georgian: კონსტიტუციური შეთანხმება საქართველოს სახელმწიფოსა და საქართველოს სამოციქულო ავტოკეფალურ მართლმადიდებელ ეკლესიას შორის), informally referred to as the Concordat, is an agreement between the Georgian Orthodox Church (GOC) and the state that defines relations between the two entities. It was signed by President of Georgia Eduard Shevardnadze and Patriarch of Georgia Ilia II on 14 October 2002 at Svetitskhoveli Cathedral in Mtskheta, Georgia.

  • The concordat confirms the Georgian Orthodox Church's ownership of all churches and monasteries on the territory of Georgia, including those in ruins or non-operating.
  • The agreement recognizes the special role of the GOC in the history of Georgia and devolves authority over all religious matters to it.
  • The concordat also gives the patriarch legal immunity, grants the GOC the exclusive right to staff the military chaplaincy, exempts GOC clergymen from military service, and gives the GOC a unique consultative role in government, especially in the sphere of education.
  • The government of Georgia recognizes the legitimacy of the wedding ceremonies performed by the Georgian Orthodox Church, while maintaining that in legal matters government records must be used.

Concordat in the context of Concordat of 1801

The Concordat of 1801 was an agreement between the First French Republic and the Holy See, signed by First Consul Napoleon Bonaparte and Pope Pius VII on 15 July 1801 in Paris. It remained in effect until 1905, except in Alsace–Lorraine, where it remains in force. It sought national reconciliation between the French Revolution and Catholics and solidified the Roman Catholic Church as the majority church of France, with most of its civil status restored. This resolved the hostility of devout French Catholics against the revolutionary state. It did not restore the vast Church lands and endowments that had been seized during the Revolution and sold off. Catholic clergy returned from exile, or from hiding, and resumed their traditional positions in their traditional churches. Very few parishes continued to employ the priests who had accepted the Civil Constitution of the Clergy of the revolutionary regime. While the Concordat restored much power to the papacy, the balance of church-state relations tilted firmly in Bonaparte's favour. He selected the bishops and supervised church finances.

Bonaparte and the Pope both found the Concordat useful. Similar arrangements were made with the Church in territories controlled by France, especially Italy and Germany.

Concordat in the context of Prince-Bishopric of Würzburg

The Prince-Bishopric of Würzburg (German: Fürstbistum Würzburg; Hochstift Würzburg) was an ecclesiastical principality of the Holy Roman Empire located in Lower Franconia, west of the Prince-Bishopric of Bamberg. Würzburg had been a diocese since 743. As established by the Concordat of 1448, bishops in Germany were chosen by the canons of the cathedral chapter and their election was later confirmed by the pope. Following a common practice in Germany, the prince-bishops of Würzburg were frequently elected to other ecclesiastical principalities as well. The last few prince-bishops resided at the Würzburg Residence, which is one of the grandest Baroque palaces in Europe.

As a consequence of the 1801 Treaty of Lunéville, Würzburg, along with the other ecclesiastical states of Germany, was secularized in 1803 and absorbed into the Electorate of Bavaria. In the same year Ferdinand III, former Grand Duke of Tuscany, was compensated with the Electorate of Salzburg. In the 1805 Peace of Pressburg, Ferdinand lost Salzburg to the Austrian Empire, but was compensated with the new Grand Duchy of Würzburg, Bavaria having relinquished the territory in return for the Tyrol. This new state lasted until 1814, when it was once again annexed by Bavaria.

Concordat in the context of Patronato real

The patronato (lit.'patronage') system in Spain (and a similar padroado system in Portugal) was the expression of royal patronage controlling major appointments of Church officials and the management of Church revenues, under terms of concordats with the Holy See. The resulting structure of royal power and ecclesiastical privileges, was formative in the Spanish Empire. It resulted in a characteristic constant intermingling of trade, politics, and religion. The papacy granted the power of patronage to the monarchs of Spain and Portugal to appoint clerics because the monarchs "were willing to subsidize missionary activities in newly conquered and discovered territories."

Concordat in the context of Reichskonkordat

The Reichskonkordat ("Concordat between the Holy See and the German Reich") is a treaty negotiated between the Vatican and the emergent Nazi Germany. It was signed on 20 July 1933 by Cardinal Secretary of State Eugenio Pacelli, who later became Pope Pius XII, on behalf of Pope Pius XI and Vice Chancellor Franz von Papen on behalf of President Paul von Hindenburg and the German government. It was ratified 10 September 1933 and it remains in force to this day. The treaty guarantees the rights of the Catholic Church in Germany. When bishops take office, Article 16 states they are required to take an oath of loyalty to the Governor or President of the German Reich established according to the constitution. The treaty also requires all clergy to abstain from working in and for political parties. Nazi breaches of the agreement began after it had been signed and intensified afterwards. The Church protested, including in the 1937 Mit brennender Sorge encyclical of Pope Pius XI. The Nazis planned to eliminate the Church's influence by restricting its organizations to purely religious activities.

The Reichskonkordat is the most controversial of several concordats that the Vatican negotiated during the pontificate of Pius XI. It is frequently discussed in works that deal with the rise of Adolf Hitler in the early 1930s and the Holocaust. The concordat has been described by some as giving moral legitimacy to the Nazi regime after Hitler had acquired quasi-dictatorial powers through the Enabling Act of 1933, an Act itself facilitated through the support of the Catholic Centre Party.

Concordat in the context of Wittenberg Concord

Wittenberg Concord, is a religious concordat signed by Reformed and Evangelical Lutheran theologians and churchmen on 29 May 1536 as an attempted resolution of their differences with respect to the Real Presence of Christ's body and blood in the Eucharist. It is considered a foundational document for Evangelical Lutheranism but was later rejected by the Reformed.

The Reformed signers included Martin Bucer, Wolfgang Fabricius Capito, Matthäus Alber, Martin Frecht, Jakob Otter, and Wolfgang Musculus. The Lutheran signers included Martin Luther, Philipp Melanchthon, Johannes Bugenhagen, Justus Jonas, Caspar Cruciger, Justus Menius, Friedrich Myconius, Urban Rhegius, George Spalatin. This document defined the doctrine of the Real Presence of Christ's body and blood in the Eucharist as the Sacramental Union and maintained the real eating of the body and blood of Christ by "unworthy communicants" (manducatio indignorum).
