Supreme state organ of power in the context of Congress of People's Deputies of Russia

The Congress of People's Deputies of the Russian SFSR (Russian: Съезд народных депутатов РСФСР) and since 1992 Congress of People's Deputies of the Russian Federation (Russian: Съезд народных депутатов Российской Федерации) was the highest organ of state authority in the Russian SFSR and in the Russian Federation from 16 May 1990 to 21 September 1993. Elected on 4 March 1990 for a period of five years, it was dissolved (without constitutional authority) by presidential decree during the Russian constitutional crisis of 1993 and ended de facto when the Russian White House was attacked on 4 October 1993. The Congress played an important role in some of the most important events in the history of Russia during this period, such as the declaration of state sovereignty of Russia within the USSR (June 1990), the rise of Boris Yeltsin, and economic reforms.

Supreme state organ of power in the context of Unified power

Unified power is a Marxist–Leninist principle on communist state power that was developed in opposition to the separation of powers. It holds that popular sovereignty is expressed through a single representative organ, the supreme state organ of power (SSOP), which exercises legislative, executive, judicial, and all other forms of state power. Lower-level state organs of power are not autonomous polities but administrative extensions of the SSOP within a single hierarchy. Central decisions bind subordinate levels, while local organs are accountable both to their electors and to superior organs, a system known as dual subordination. This produces a uniform flow of power from the SSOP to subordinate organs, with local discretion allowed only within jurisdiction delegated by higher law enacted by the SSOP.

The SSOP's relationship to the constitution and laws is fundamental. The constitution, adopted by the SSOP, is the fundamental law binding all state organs. It does not permanently restrict the SSOP's sovereign rights, since such limits are self-imposed and may be altered through constitutional amendment. Communist state constitutions set out broad principles on sovereignty and the structure of the state—while leaving specific details to statutes and secondary norms. Socialist legality, the Marxist–Leninist concept of lawful governance, requires conformity to the constitution. However, it rejects independent or autonomous institutions, such as constitutional courts exercising judicial review, that would stand above the SSOP. Instead, legality is safeguarded through political oversight by representative organs, supervision by the supreme procuratorial organ, and electoral accountability through controlled elections.

Supreme state organ of power in the context of Supreme Soviet of the Soviet Union

The Supreme Soviet of the Union of Soviet Socialist Republics (SSUSSR) was the highest organ of state authority of the Soviet Union from 1936 to 1991. Based on the principle of unified power, it was the only branch of government in the Soviet state, and headed the unified state apparatus.

Prior to 1936, the Congress of Soviets was the highest organ of state authority. During 1989–1991 a similar, but not identical organ acted as the highest organ of state authority. The Supreme Soviet appointed the Council of Ministers, the Supreme Court, and the Procurator General of the Soviet Union as well as elected the Presidium which served as the Soviet Union's collective head of state under both the 1936 and 1977 Soviet Constitutions.

Supreme state organ of power in the context of State Council of China

The State Council of the People's Republic of China, synonymous with Central People's Government, is the supreme administrative organ of China's unified state apparatus and the executive organ of the National People's Congress, the supreme organ of state power. It is composed of a premier, vice-premiers, state councilors, ministers, chairpersons of commissions, an auditor-general, the governor of the People's Bank of China, and a secretary-general.

The premier of the State Council is responsible for the State Council and exercises overall leadership of its work. The secretary-general of the State Council, under the leadership of the premier, is responsible for handling the daily work of the State Council and heads the General Office of the State Council. The executive meeting of the State Council, consisting of the premier, vice-premiers, state councilors, and the secretary-general, is held two to three times a month, while the plenary meeting, consisting of all members of the State Council, is held every six months.

In applied communist practice, a socialist state is a communist state formation that is the product of a purported base and superstructural relation that is called the socialist mode of production, or simply socialism. Socialism acts as the base of the socialist state, while the superstructure is made up of two parts: the class character of the state and the organisational form of state power.

The majority of communist states have been unable to establish a socialist state. These states had, according to Marxist–Leninist doctrine, reached a lower form of development and designated themselves, or were designated, for example, as national democratic states, states of socialist orientation or as people's democratic states.

A people's democratic state is a communist state formation. According to the Marxist–Leninist theory of people's democracy, it purportedly tries to transition society from a capitalist mode of production to a socialist mode of production after a successful people's democratic revolution. This process transforms the people's democratic state into a socialist state.

According to Marxist–Leninist theorists, the people's democratic state is socialist-type state, but not a socialist state itself. The form of government of people's democratic states is unified state power of the supreme state organ of power, under the leadership of the ruling communist party. Despite this, forms of government have not always been identical in different states, with some slight institutional differences.

The Supreme Soviet (Russian: Верховный Совет, romanizedVerkhovny Sovet, lit.'Supreme Council') was the common name for the highest organs of state authority of the Soviet socialist republics (SSR) in the Union of Soviet Socialist Republics (USSR). These soviets were modeled after the Supreme Soviet of the USSR, established in 1938, and were nearly identical.

Party-approved delegates to the Supreme Soviets were periodically elected unopposed in show elections. The first free or semi-free elections took place during perestroika in late 1980s, in which Supreme Soviets themselves were no longer directly elected. Instead, Supreme Soviets were appointed by directly elected Congresses of People's Deputies based somewhat on the Congresses of Soviets that preceded the Supreme Soviets. The soviets until then were largely rubber-stamp institutions, approving decisions handed to them by the Communist Party of the USSR or of each SSR.

A communist state constitution is the supreme and fundamental law of a communist state. In Marxist–Leninist theory, a constitution is understood both as a juridical act that establishes the structure of the state and its legal order, and as the formal expression of the prevailing class system controlled by the ruling class. Communist constitutions codify the political and economic programme of the ruling communist party and are considered to hold supreme legal force, providing the foundation for all legislation and state activity. Unlike liberal constitutional systems, communist state constitutions reject the separation of powers and judicial review, vesting the unified powers of the state in a supreme state organ of power (SSOP). The constitution defines the structure and functioning of other state organs as an act of the SSOP’s self-organisation, not as an imposition upon it in accordance with the division of labour of state organs.

Communist constitutions share a broadly similar structure: a preamble outlining ideological goals; chapters on the political and economic system, often emphasising the leading role of the party, providing a normative framework for the transition to a communist society, public ownership and planned economic development; sections defining the organisation of state power, including the SSOP, its permanent organ, the supreme executive and administrative organ, the supreme judicial organ, the supreme procuratorial organ, and other state organs if needed; and chapters detailing citizens' rights and obligations. Rights are paired with corresponding obligations, reflecting the view that rights are not natural entitlements but contingent upon fulfilling social obligations. Legal systems operate under the principle of socialist law, which requires state organs, transmission belt mass organisations, and citizens to observe the constitution and laws. The procuracy typically supervises legality; constitutional enforcement is ordinarily vested in the SSOP or its permanent organ (with occasional specialised committees or courts).
