A peace treaty is an agreement between two or more hostile parties, usually countries or governments, which formally ends a state of war between the parties. It is different from an armistice, which is an agreement to stop hostilities; a surrender, in which an army agrees to give up arms; or a ceasefire or truce, in which the parties may agree to temporarily or permanently stop fighting.

The need for a peace treaty in modern diplomacy arises from the fact that even when a war is actually over and fighting has ceased, the legal state of war is not automatically terminated upon the end of actual fighting and the belligerent parties are still legally defined as enemies. This is evident from the definition of a "state of war" as "a legal state created and ended by official declaration regardless of actual armed hostilities and usually characterized by operation of the rules of war". As a result, even when hostilities are over, a peace treaty is required for the former belligerents in order to reach an, agreement on all issues involved in transition to a legal state of peace. The art of negotiating a peace treaty in the modern era has been referred to by legal scholar Christine Bell as the lex pacificatoria, with a peace treaty potentially contributing to the legal framework governing the post conflict period, or jus post bellum.

Peace treaty in the context of North Korea

North Korea, officially the Democratic People's Republic of Korea (DPRK), is a country in East Asia. It constitutes the northern half of the Korean Peninsula and borders China and Russia to the north at the Yalu (Amnok) and Tumen rivers, and South Korea to the south at the Korean Demilitarized Zone (DMZ). The country's western border is formed by the Yellow Sea, while its eastern border is defined by the Sea of Japan. North Korea, like South Korea, claims to be the sole legitimate government of the Korean Peninsula and adjacent islands. Pyongyang is the capital and largest city.

The Korean Peninsula was first inhabited as early as the Lower Paleolithic period. Its first kingdom was noted in Chinese records in the early 7th century BCE. Following the unification of the Three Kingdoms of Korea into Silla and Balhae in the late 7th century, Korea was ruled by the Goryeo dynasty (918–1392) and the Joseon dynasty (1392–1897). The succeeding Korean Empire (1897–1910) was annexed in 1910 into the Empire of Japan. In 1945, after the Japanese surrender at the end of World War II, Korea was divided into two zones along the 38th parallel, with the north occupied by the Soviet Union and the south occupied by the United States. In 1948, separate governments were formed in Korea: the socialist and Soviet-aligned Democratic People's Republic of Korea in the north, and the capitalist, Western-aligned Republic of Korea in the south. The North Korean invasion of South Korea in 1950 started the Korean War. In 1953, the Korean Armistice Agreement brought about a ceasefire and established a demilitarized zone (DMZ), but no formal peace treaty has ever been signed. Post-war North Korea benefited greatly from economic aid and expertise provided by other Eastern Bloc countries. However, Kim Il Sung, North Korea's first leader, promoted his personal philosophy of Juche as the state ideology. Pyongyang's international isolation sharply accelerated from the 1980s onwards as the Cold War came to an end. The fall of the Soviet Union in 1991 then brought about a sharp decline to the North Korean economy. From 1994 to 1998, North Korea suffered a famine with the population continuing to suffer from malnutrition. In 2024, the DPRK formally abandoned efforts to reunify Korea.

The Treaty of Lausanne (French: Traité de Lausanne, Turkish: Lozan Antlaşması) is a peace treaty negotiated during the Lausanne Conference of 1922–1923 and signed in the Palais de Rumine in Lausanne, Switzerland, on 24 July 1923. The treaty officially resolved the conflict that had initially arisen between the Ottoman Empire and the Allied French Republic, British Empire, Kingdom of Italy, Empire of Japan, Kingdom of Greece, Kingdom of Serbia, and the Kingdom of Romania since the outset of World War I. The original text of the treaty is in English and French. It emerged as a second attempt at peace after the failed and unratified Treaty of Sèvres, which had sought to partition Ottoman territories. The earlier treaty, signed in 1920, was later rejected by the Turkish National Movement which actively opposed its terms. As a result of Greek defeat in the Greco-Turkish War, Turkish forces recaptured İzmir, and the Armistice of Mudanya was signed in October 1922. This armistice provided for the exchange of Greek-Turkish populations and allowed unrestricted civilian, non-military passage through the Turkish Straits.

Turkey ratified the treaty on 23 August 1923, and all other signatories did so by 16 July 1924. The Treaty of Lausanne became effective on 6 August 1924.

Peace treaty in the context of Treaty of Gulistan

The Treaty of Gulistan (also spelled Golestan: Russian: Гюлистанский договор, romanizedGyulistanskiy dogovor; Persian: عهدنامه گلستان, romanizedAhdnāme-ye Golestān) was a peace treaty concluded between the Russian Empire and Qajar Iran on 24 October 1813 in the village of Gulistan (now in the Goranboy District of Azerbaijan) as a result of the first full-scale Russo-Persian War (1804 to 1813). The peace negotiations were precipitated by the successful storming of Lankaran by General Pyotr Kotlyarevsky on 1 January 1813. It was the first of a series of treaties (the last being the Akhal Treaty) signed between Qajar Iran and Imperial Russia that forced Persia to cede the territories that formerly were part of Iran.

The treaty confirmed the ceding and inclusion of what is now Dagestan, eastern Georgia, most of the Republic of Azerbaijan, and parts of northern Armenia from Iran into the Russian Empire.

The Treaty of Apamea was a peace treaty conducted in 188 BC between the Roman Republic and Antiochus III, ruler of the Seleucid Empire. It ended the Roman–Seleucid War. The treaty took place after Roman victories at the Battle of Thermopylae (in 191 BC), the Battle of Magnesia (in 190 BC), and after Roman and Rhodian naval victories over the Seleucid navy.

Peacekeeping comprises activities intended to create conditions that favor lasting peace. Research generally finds that peacekeeping reduces civilian and battlefield deaths, as well as reduces the risk of renewed warfare.

Within the United Nations (UN) group of nation state governments and organizations, there is a general understanding that at the international level, peacekeepers monitor and observe peace processes in post-conflict areas, and may assist ex-combatants in implementing peace agreement commitments that they have undertaken. Such assistance may come in many forms, including confidence-building measures, power-sharing arrangements, electoral support, strengthening the rule of law, and economic and social development. The Peace of Utrecht was a series of peace treaties signed by the belligerents in the War of the Spanish Succession, in the Dutch city of Utrecht between April 1713 and February 1715. The war involved three contenders for the vacant throne of Spain, and had involved much of Europe for over a decade. Essentially, the treaties allowed Philip V (grandson of King Louis XIV of France) to keep the Spanish throne in return for permanently renouncing his claim to the French throne, along with other necessary guarantees that would ensure that France and Spain should not merge, thus preserving the balance of power in Europe.

The treaties between several European states, including Spain, Great Britain, France, Portugal, Savoy and the Dutch Republic, helped end the war. The treaties were concluded between the representatives of Louis XIV of France and of his grandson Philip on one hand, and representatives of Queen Anne of Great Britain, King Victor Amadeus II of Sardinia, King John V of Portugal and the United Provinces of the Netherlands on the other. Though the king of France ensured the Spanish crown for his dynasty, the treaties marked the end of French ambitions of hegemony in Europe expressed in the continuous wars of Louis XIV, and paved the way to the European system based on the balance of power.

Peace treaty in the context of Treaty of Küçük Kaynarca

The Treaty of Küçük Kaynarca (Turkish: Küçük Kaynarca Antlaşması; Russian: Кючук-Кайнарджийский мир), formerly often written Kuchuk-Kainarji, was a peace treaty signed on 21 July [O.S. 10 July] 1774, in Küçük Kaynarca (today Kaynardzha, Bulgaria) between the Russian Empire and the Ottoman Empire, ending the Russo-Turkish War of 1768–1774 with major concessions to Russia. The concessions to Russia were not merely territorial; not only was the Crimea Khanate (not Crimea proper) ceded, but Russia also gained the right to construct a Russian Orthodox church in Constantinople, claiming to be the protector of the Orthodox Christians in the Ottoman Empire. This was a pretext for frequent and numerous interventions in the decades to follow. Ottoman Christians started to feel more empowered as European and Christian powers demonstrated their rising influence and political power. Access to Europe's political networks, markets and educational institutions created a class privilege for Ottoman Christians, and scholars often regard the treaty as turning point for relations between Ottoman Christians and the European nations.

The treaty was a milestone in the history of the decline of the Ottoman Empire, as for the first time a foreign power had a say in the governance of the Porte in assuming direct responsibility for the fate of the Empire's Orthodox Christian subjects.
