The just war theory (Latin: bellum iustum) is a doctrine, also referred to as a tradition, of military ethics that aims to ensure that a war is morally justifiable through a series of criteria, all of which must be met for a war to be considered just. It has been studied by military leaders, theologians, ethicists and policymakers. The criteria are split into two groups: jus ad bellum ("right to go to war") and jus in bello ("right conduct in war"). There have been calls for the inclusion of a third category of just war theory (jus post bellum) dealing with the morality of post-war settlement and reconstruction. The just war theory postulates that war, while it is terrible but less so with the right conduct, is not always the worst option, but justifiable when justice is an objective of armed conflict. Important responsibilities, undesirable outcomes, or preventable atrocities may justify war.

Opponents of the just war theory may either be inclined to a stricter pacifist standard (proposing that there has never been nor can there ever be a justifiable basis for war) or they may be inclined toward a more permissive nationalist standard (proposing that a war need only to serve a nation's interests to be justifiable). In many cases, philosophers state that individuals do not need to be plagued by a guilty conscience if they are required to fight. A few philosophers ennoble the virtues of the soldier while they also declare their apprehensions for war itself. A few, such as Rousseau, argue for insurrection against oppressive rule.

Just war in the context of Dharmaśāstra

Dharmaśāstra (Sanskrit: धर्मशास्त्र) are Sanskrit Puranic Smriti texts on law and conduct, and refer to treatises (śāstras) on Dharma. Like the Dharmasūtras which are based upon the Vedas, these texts are also elaborate law commentaries based on the Vedas, and evolved from Dharmasutras. There are many Dharmaśāstras, variously estimated to number from 18 to over 100. Each of these texts exists in many different versions, and each is rooted in Dharmasutra texts dated to the 1st millennium BCE that emerged from Kalpa (Vedanga) studies in the Vedic era.

The textual corpus of Dharmaśāstra were composed in poetic verse, and are part of the Hindu Smritis, constituting divergent commentaries and treatises on ethics particularly duties, and responsibilities to oneself and family as well as those required as a member of society. The texts include discussion of ashrama (stages of life), varna (social classes), purushartha (proper goals of life), personal virtues and duties such as ahimsa (non-violence) against all living beings, rules of just war, and other topics.

Just war in the context of Francisco de Vitoria

Francisco de Vitoria OP (c. 1483 – 12 August 1546; also known as Francisco de Victoria) was a Spanish Roman Catholic philosopher, theologian, and jurist of Renaissance Spain. He is the founder of the tradition in philosophy known as the School of Salamanca, which laid the groundwork for early free-market economics and individual rights, influencing the development of libertarian thought. Vitoria's work on natural law and the freedom of exchange contributed to later Austrian School economists' emphasis on the moral basis for voluntary commerce. Although less known than others of his kind, he has been considered one of the most influential humanists of the Renaissance.

Noted especially for his concept of just war and international law, his defense of individual property rights and the notion of liberty in trade were pivotal in shaping ideas about non-intervention and economic freedom. He has in the past been described by scholars as the "father of international law", along with Alberico Gentili and Hugo Grotius. American jurist Arthur Nussbaum noted Vitoria's influence on international law as it pertained to the right to trade overseas. Later this was interpreted as "freedom of commerce". His emphasis on voluntary exchange and opposition to monopolistic practices foreshadowed later free market economics.
