Jean Bodin (/bˈdæn/; French: [ʒɑ̃ bɔdɛ̃]; c. 1530 – 1596) was a French jurist and political philosopher, member of the Parlement of Paris and professor of law in Toulouse. Bodin lived during the aftermath of the Protestant Reformation and wrote against the background of religious conflict in France. He seemed to be a nominal Catholic throughout his life but was critical of papal authority over governments. Known for his theory of sovereignty, he favoured the strong central control of a national monarchy as an antidote to factional strife.

Towards the end of his life he wrote a dialogue among different religions, including representatives of Judaism, Islam and natural theology in which all agreed to coexist in concord, but was not published. He was also an influential writer on demonology, as his later years were spent during the peak of the early modern witch trials.

Jean Bodin in the context of Westphalian sovereignty

The Westphalian system, also known as Westphalian sovereignty, is a principle in international law that each state has exclusive sovereignty over its territory. The principle developed in Europe after the Peace of Westphalia in 1648, based on the state theory of Jean Bodin and the natural law teachings of Hugo Grotius. It underlies the modern international system of sovereign states and is enshrined in the United Nations Charter, which states that "nothing ... shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state."

According to the principle, every state, no matter how large or small, has an equal right to sovereignty. Political scientists have traced the concept to the eponymous peace treaties that ended the Thirty Years' War (1618–1648) and Eighty Years' War (1568–1648). The principle of non-interference was further developed in the 18th century. The Westphalian system reached its peak in the 19th and 20th centuries, but has faced recent challenges from advocates of humanitarian intervention.

Jean Bodin in the context of Monopoly on violence

In political philosophy, a monopoly on violence or monopoly on the legal use of force is the property of a polity that is the only entity in its jurisdiction to legitimately use force, and thus the supreme authority of that area.

While the monopoly on violence as the defining conception of the state was first described in sociology by Max Weber in his essay Politics as a Vocation (1919), the monopoly of the legitimate use of physical force is a core concept of modern public law, which goes back to French jurist and political philosopher Jean Bodin's 1576 work Les Six livres de la République and English philosopher Thomas Hobbes's 1651 book Leviathan. Weber claims that the state is the "only human Gemeinschaft which lays claim to the monopoly on the legitimate use of physical force. As such, states can resort to coercive means such as incarceration, expropriation, humiliation, and death threats to obtain the population's compliance with its rule and thus maintain order. However, this monopoly is limited to a certain geographical area, and in fact this limitation to a particular area is one of the things that defines a state." In other words, Weber describes the state as any organization that succeeds in holding the exclusive right to use, threaten, or authorize physical force against residents of its territory. Such a monopoly, according to Weber, must occur via a process of legitimation.

Jean Bodin in the context of Conflict theories

Conflict theories are perspectives in political philosophy and sociology which argue that individuals and groups (social classes) within society interact on the basis of conflict rather than agreement, while also emphasizing social psychology, historical materialism, power dynamics, and their roles in creating power structures, social movements, and social arrangements within a society. Conflict theories often draw attention to power differentials, such as class conflict, or a conflict continuum. Power generally contrasts historically dominant ideologies, economies, currencies or technologies. Accordingly, conflict theories represent attempts at the macro-level analysis of society.

Many political philosophers and sociologists have been framed as having conflict theories, dating back as far as Plato's idea of the tripartite soul of The Republic, to Hobbes' ideas in The Leviathan. Other historical political philosophers associated with having "conflict theories" include Jean Bodin, Adam Smith, John Stuart Mill, Thomas Robert Malthus, Karl Marx, and Georg Simmel. Georg Simmel was one of the earliest sociologists to formally use "conflict" as a framework to understand social change, writing about the topic in his 1908 book, "Conflict and the Web of Group Affiliations".
