The Fourteenth Amendment (Amendment XIV) to the United States Constitution was adopted on July 9, 1868, as one of the Reconstruction Amendments. Considered one of the most consequential amendments, it addresses citizenship rights and equal protection under the law at all levels of government. The Fourteenth Amendment was a response to issues affecting freed slaves following the American Civil War, and its enactment was bitterly contested. States of the defeated Confederacy were required to ratify it to regain representation in Congress. The amendment, particularly its first section, is one of the most litigated parts of the Constitution, forming the basis for landmark Supreme Court decisions, such as Brown v. Equal Protection Clause in the context of Brown v. Board of Education

Brown v. Board of Education of Topeka, 347 U.S. 483 (1954), was a landmark decision of the United States Supreme Court which ruled that U.S. state laws establishing racial segregation in public schools violate the Equal Protection Clause of the Fourteenth Amendment and hence are unconstitutional, even if the segregated facilities are presumed to be equal. The decision partially overruled the Court's 1896 decision Plessy v. Ferguson, which had held that racial segregation laws did not violate the U.S. Constitution as long as the facilities for each race were equal in quality, a doctrine that had come to be known as "separate but equal" and was rejected in Brown based on the argument that separate facilities are inherently unequal. The Court's unanimous decision in Brown and its related cases paved the way for integration and was a major victory of the civil rights movement, and a model for many future impact litigation cases.

The case involved the public school system in Topeka, Kansas, which in 1951 had refused to enroll the daughter of local black resident Oliver Brown at the school closest to her home, instead requiring her to ride a bus to a segregated black school farther away. The Browns and twelve other local black families in similar situations filed a class-action lawsuit in U.S. federal court against the Topeka Board of Education, alleging its segregation policy was unconstitutional. A special three-judge court of the U.S. District Court for the District of Kansas heard the case and ruled against the Browns, relying on the precedent of Plessy and its "separate but equal" doctrine. The Browns, represented by NAACP chief counsel Thurgood Marshall, appealed the ruling directly to the Supreme Court, who issued a unanimous 9–0 decision in favor of the Browns. However, the decision's 14 pages did not spell out any sort of method for ending racial segregation in schools, and the Court's second decision in Brown II (1955) only ordered states to desegregate "with all deliberate speed".

Equal Protection Clause in the context of Same-sex marriage in the United States

The legal recognition of same-sex marriage in the United States expanded from one state in 2004 (Massachusetts) to all 50 states in 2015 through various court rulings, state legislation, and direct popular vote. States have separate marriage laws, which must adhere to rulings by the Supreme Court of the United States that recognize marriage as a fundamental right guaranteed by both the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution, as first established in the 1967 landmark civil rights case of Loving v. Virginia. Same-sex marriages are also licensed in and recognized by Washington, D.C. and all U.S. territories except for American Samoa, but not in some Native American tribal nations.

Civil rights campaigning in support of marriage without distinction as to sex or sexual orientation began in the 1970s. In 1972, the later-overturned Baker v. Nelson saw the Supreme Court of the United States decline to become involved. The issue became prominent from around 1993, when the Supreme Court of Hawaii ruled in Baehr v. Lewin that it was unconstitutional under the Constitution of Hawaii for the state to abridge marriage on the basis of sex. That ruling led to federal and state actions to explicitly abridge marriage on the basis of sex in order to prevent the marriages of same-sex couples from being recognized by law, the most prominent of which was the 1996 federal Defense of Marriage Act (DOMA). In 2003, the Massachusetts Supreme Judicial Court ruled in Goodridge v. Department of Public Health that it was unconstitutional under the Constitution of Massachusetts for the state to abridge marriage on the basis of sex. From 2004 through to 2015, as the tide of public opinion continued to move towards support of same-sex marriage, various state court rulings, state legislation, direct popular votes (referendums and initiatives), and federal court rulings established same-sex marriage in thirty-six of the fifty states.

Equal Protection Clause in the context of Civil Rights Act of 1964

The Civil Rights Act of 1964 (Pub. L. 88–352, 78 Stat. 241, enacted July 2, 1964) is a landmark civil rights and labor law in the United States that outlaws discrimination based on race, color, religion, sex, and national origin. It prohibits unequal application of voter registration requirements, racial segregation in schools and public accommodations, and employment discrimination. The act "remains one of the most significant legislative achievements in American history".

Initially, powers given to enforce the act were weak, but these were supplemented during later years. Congress asserted its authority to legislate under several different parts of the United States Constitution, principally its enumerated power to regulate interstate commerce under the Commerce Clause of Article I, Section 8, its duty to guarantee all citizens equal protection of the laws under the 14th Amendment, and its duty to protect voting rights under the 15th Amendment.

Equal Protection Clause in the context of Bush v. Gore

Bush v. Gore, 531 U.S. 98 (2000), was a landmark decision of the United States Supreme Court on December 12, 2000, that settled a recount dispute in Florida's 2000 presidential election between George W. Bush and Al Gore. On December 8, the Florida Supreme Court had ordered a statewide recount of all undervotes, over 61,000 ballots that the vote tabulation machines had missed. The Bush campaign immediately asked the U.S. Supreme Court to stay the decision and halt the recount. Justice Antonin Scalia, contending that all the manual recounts being performed in Florida's counties were illegitimate, urged his colleagues to grant the stay immediately. On December 9, the five conservative justices on the Court granted the stay, with Scalia citing "irreparable harm" that could befall Bush, as the recounts would cast "a needless and unjustified cloud" over Bush's legitimacy. In dissent, Justice John Paul Stevens wrote that "counting every legally cast vote cannot constitute irreparable harm." Oral arguments were scheduled for December 11.

In a 5–4 per curiam decision, the Court ruled, strictly on equal protection grounds, that the recount be stopped. Specifically, it held that the use of different standards of counting in different counties violated the Equal Protection Clause of the U.S. Constitution; the case had also been argued on Article II jurisdictional grounds, which found favor with only justices Antonin Scalia, Clarence Thomas, and William Rehnquist. The Court then ruled as to a remedy, deciding against the one, proposed by Justices Stephen Breyer and David Souter, of sending the case back to Florida to complete the recount using a uniform statewide standard before the scheduled December 18 meeting of Florida's electors in Tallahassee. Instead, the majority held that no alternative method could be established within the discretionary December 12 "safe harbor" deadline set by Title 3 of the United States Code (3 U.S.C.), § 5, which the Florida Supreme Court had said the Florida Legislature intended to meet. The Court, holding that not meeting the "safe harbor" deadline would violate the Florida Election Code, rejected an extension of the deadline to allow the Florida court to finish counting disputed ballots under uniform guidelines requested in a remedy proposed by Breyer and Souter. That deadline arrived two hours after the release of the Court's decision.

Equal Protection Clause in the context of Loving v. Virginia

Loving v. Virginia, 388 U.S. 1 (1967), was a landmark civil rights decision of the United States Supreme Court that ruled that the laws banning interracial marriage violate the Equal Protection and Due Process clauses of the Fourteenth Amendment to the U.S. Constitution. Beginning in 2013, the decision was cited as precedent in U.S. federal court decisions ruling that restrictions on same-sex marriage in the United States were unconstitutional, including in the Supreme Court decision Obergefell v. Hodges (2015).

The case involved Richard Loving, a white man, and his wife Mildred Loving, a woman of color. In 1959, the Lovings were convicted of violating Virginia's Racial Integrity Act of 1924, which criminalized marriage between people classified as "white" and people classified as "colored". Caroline County circuit court judge Leon M. Bazile sentenced them to prison but suspended the sentence on the condition that they leave Virginia and not return. The Lovings filed a motion to vacate their convictions on the ground that the Racial Integrity Act was unconstitutional, but Bazile denied it. After unsuccessfully appealing to the Supreme Court of Virginia, the Lovings appealed to the U.S. Supreme Court, which agreed to hear their case.
